HomeMy WebLinkAbout1667ORDINANCE NO. /66 7 AN ORDINANCE relating to and regulating the making of loud, disturbing and unnecessary noises. All ordi- nances in conflict are herewith repealed. BE IT ORDAINED BY THE CITY OF PORT ANGELES, as follows: Section 1. Definitions: A. Motor vehicle shall mean every vehicle which is self propelled. B. "Allowable level of noise" means not more than 90 deci- bels as measured on the "A" Scale of a General Radio type 1565 A sound level meter or equivalent using the "A" weighted ambient sound level at a distance of not less than 20 feet from source of the noise. Section 2. It shall be unlawful: A. To sound any horn or other signalling device on any street or public place of the City, except as specifically per- mitted or required by law or as a danger warning, and the sound- ing of any such device for an unnecessary period of time. B. To use any motor vehicle which because of it being out of repair or because of its not being loaded properly or because of the manner of operations creates a loud and disturbing noise. C. To create a loud and disturbing noise in connection with unloading or loading any vehicle or the opening and destruc- tion of bales, boxes and containers between 9:00 P.M. and 6:00 A.M. D. To operate any noise creating blower or power fan, un- less the noise from such blower or power fan is adequately muffled. E. To play any radio or television set, musical instru- ment, phonograph, or other machine or device for producing or re- producing sound in such manner as to disturb the peace, quiet and comfort of neighboring inhabitants. F. To yell, shout, hoot, whistle or sing on the public streets or any other place so as to annoy or disturb the quiet, comfort, or repose of any persons in any office or in any dwell- ing, hotel or other type of residence or of anyone in the vicin- ity. G. To use in a .residential zone or in the vicinity of a hotel, motel or hospital hand or power tools or machinery, result- ing in loud and disturbing noises between the hours of 9:00 P.M. and 6:00 A.M. H. To sound sirens except where specifically required or permitted by law. I. To keep any bird or animal which emits frequent or continuous noise so as to disturb the peace, quiet and comfort of the adjacent residents. J. To use any radio or television set, musical instrument, phonograph, loud speaker, sound amplifier, bell, drum, horn, or other machine or device for the producing or reproducing of sound directed upon public streets for the purpose of commercial adver- tising or attracting the attention of public to any building, structure or tent. The Chief of Police may issue written permits for temporary exceptions for civic events or for civic or reli- gious organizations, or for the playing of music during the Christmas season for such periods of time and under such condi- tions as may be consistent with the public interest. K. To blow any locomotive whistle or whistle attached to any stationary boiler or mechanical whistle, except to give notice of the time to begin or stop work or as a warning of fire or dan- ger or upon request of city officials. Section 3. Exhausts: A. The discharge into the open air of any steam engine, F • stationary or portable internal combustion engine, or motor ve- hicle except through a muffler in good repair or other device which will effectively prevent loud disturbing noises therefrom is unlawful; provided that, when such steam engine, stationary or combustion engine is enclosed within a building, the allowable level of noise shall be measured at the nearest point on the boundary of the property. B. The exhaust from a motor vehicle shall not be directed to the side of the vehicle between 2 feet and 11 feet above the ground. Section 4: It shall be unlawful to operate a motor vehicle, combina- tion of vehicles, motorcycle or any other vehicle of a type sub- ject to the license provisions of the State of Washington, over and along the streets of the City of Port Angeles with a decibel reading in excess of 90 decibels as determined by using a General Radio Type 1565 A Sound Level Meter or equivalent using the A weighted ambient sound level at a distance of not less than 20 feet from source of the noise being measured. Section 5. 'The sound level meter shall be operated using: A. The A weighting and the fast meter response. B. The reading recorded shall be the highest sound level obtained as the vehicle passes by, disregarding unrelated peaks due to extraneous ambient noises. C. Measurements shall be made only when the A weighted ambient sound level, including wind effects, due to all sources other than the vehicle being measured is at least 10 decibels lower than the sound level of the vehicle. A. A tolerance of not more than plus 2 decibels may be allowed due to unavoidable variations in testing vehicle operation • • E. Locations shall be in open areas far from large re- flecting surfaces. F. Given conditions shall be relatively smooth concrete or asphalt pavement free from standing water and shrubbery or grass more than six inches high. G. Wind conditions shall not exceed 10 m.p.h. at test site. Section 6. All vehicles or combination of vehicles using engine brakes shall comply with the sound level of not more than 90 decibels. Testing of vehicles using the engine brake shall be on a down grade as brake is placed in operation.
