HomeMy WebLinkAbout1682ORDINANCE NO. /6 �a AN ORDINANCE establishing a work release program for City prisoners. Section 1. When a convicted person is adjudged to pay a fine and costs by the Police Judge of the City of Port Angeles, he shall be committed to the custody of the Police Chief until the fine and costs are paid or secured as provided by law. Section 2. Any person imprisoned under Section 1 of this Ordinance shall remain in the City Jail until such fine and costs are paid, or until he has been imprisoned in such jail one day for every Eight Dollars ($8.00) of such fine and costs for every day the person committed does not perform labor while impri- soned and one day for every Ten Dollars ($10.00) of such fine and costs for every day the defendant performs labor as directed by the Police Chief of the City of Port Angeles. Persons performing labor as directed by the Police Chief shall receive a noon meal. Section 3. The Chief of Police may extend the limits of confinement of a prisoner as to whom there is reasonable cause to believe he will honor this trust by authorizing him under the prescribed conditions to: A. Visit a dying relative. B. Attend a funeral of a relative. C. Contact a prospective employer. D. Attend an educational institution for the purpose of learning. E. Work at paid employment. F. Work as a volunteer on community projects. G. Work on jobs for governmental agencies. H. Attend the church of his choice. I. For medical reasons. Section 4. Such release plan shall require that the prisoner be confined during the hours not reasonably necessary to implement the plan in the Port Angeles City Jail or other suitable supervised facilities approved by the Chief of Police for the housing of work release prisoners. Section 5. Any prisoner serving a sentence in the City Jail may make application to participate in a work release plan to the Chief of Police. Such application shall set forth the name and address of his proposed employer or shall specify the purpose for his application for release, as specified in Section 3. The prisoner shall agree to abide to all terms and conditions of the work release plan. The Chief of Police may revoke the work release approval. Section 6. Any prisoner approved for the work release plan who fails to return to the designated place of confinement at the time specified shall be deemed an escapee and fugitive from Justice, and subject to the general penalties of the City of Port Angeles. Section 7. The Chief of Police shall set forth rules necessary for the administration of the work release program. Section 8. All participants who are engaged in employ- ment or training shall not be considered agents, employees or involuntary servants of the City of Port Angeles, the Police Department, the Chief of Police or other officers of the department provided; that such work release participants shall be entitled to all benefits and privileges in their employment as is extended to other employees, except that such work release participants shall not be eligible for unemployment compensation until released from jail.
