HomeMy WebLinkAbout1717ORDINANCE NO. / 7/ 7 AN ORDINANCE declaring certain conduct to be a misdemeanor, defining terms and establishing standards. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Any person who loiters or prowls in a place in the City at a time or in a manner not usual for law - abiding indi- viduals under circumstances that warrant alarm for the safety, privacy or well -being of persons or property in the vicinity is guilty of a misdemeanor. Section 2. Among the circumstances which may be con- sidered in determining whether such alarm is warranted is the fact that the actor takes flight upon the appearance of a police officer or authorized patrolman, refuses to identify himself, or manifestly endeavors to conceal himself or any object; provided that: these circumstances are not exclusive. Section 3. Unless flight by the actor or other circum- stances makes it impracticable, the police officer or patrolman shall prior to making an arrest for an offense under this ordi- nance afford the actor an opportunity to dispel any alarm which would otherwise be warranted, by requesting him. to identify him- self and explain his presence and conduct. Section 4. No person shall be convicted of an offense under this ordinance if the officer or patrolman did not comply with Section 3 above, or if it appears at trial that the explana- tion given by the actor was true and, if believed by the officer or patrolman at the time, would have dispelled alarm.
