HomeMy WebLinkAbout1766ORDINANCE NO. /7i;t AN ORDINANCE REGULATING THE MOVING OF BUILDINGS. The City Council of the City of Port Angeles do ordain as follows: Section 1. In addition to the requirements of the Uniform Building Code in effect in the City of Port Angeles regarding the moving of buildings, every person, firm or cor- poration desiring to move a building shall: (1) Notify public utility companies controlling or maintaining telephone, telegraph, or other overhead wires in the city at least one week before the moving date, indicating the applicant's intention to move a building or part thereof, the proposed route, and the date of moving. (2) At the time of applying for a permit, the applicant shall submit to the building official a letter or other written notification from the public utility companies stating the time they were notified of the proposed moving of the building, and a sketch of the proposed route. (3) The permittee shall: (a) Conform to all requirements which are now or may be hereafter established by the City Council; and (b) Promptly repair and make good to.the satis- faction of the City Engineer any damage to pavement, sidewalks, crosswalks, hydrants, sewers, water lines, streets, alleys, or other public or private property done or caused by the applicant, his employees, or agents in moving a building or part of a building. (c) The applicant shall file with the City Treasurer a certificate of insurance certifying applicant as the named insured under a comprehensive 1 public liability policy of insurance with a reputable insurer, with minimum policy limits of $50,000 and $100,000 for bodily injury, and $25,000 for property damage. (d) The applicant shall also pay the City Treasurer a fee of $500.00 for a permit to move a building. Provided that $450.00 of the permit fee shall be refunded to the permittee if within one year after the date on which the building was moved, the building moved complies with all applicable ordinances, rules and regulations of the City, and is in a com- pleted state. Section 2. Issuance of Permit. (1) Before issuing a permit the building official shall confer with public utility companies in an effort to estab- lish a route, a plan for moving, and a date which is satisfactory to the utility companies. (2) A permit issued under this ordinance shall speci- fically describe the route to be taken in moving the building, the approximate length of time which may be consumed in the moving process; and the day on which the moving shall start. The build- ing or part of a building moved shall not be moved on a route other than that specified in the permit. Applicant shall arrange at least 24 hours in advance with the police department for a police escort, and posting at the applicant's cost against parking where necessary. (3) If the applicant has complied with all of the re- quirements of applicable ordinances, the building official shall issue a permit to move the building, or shall refer the matter to the City Council and its decision thereafter shall be final. (4) If a permit is refused, the City Council shall • • • provide for a hearing at which the applicant may present informa- tion or relevant considerations to the City Council. Section 3. Pneumatic Equipment. A person, firm, or corporation moving a building or a part of a building over or ac- ross a street, alley, or other public property shall support the building being moved on equipment with pneumatic tires. The in- flated pneumatic tires shall be of sufficient size to reasonably carry the load being moved without damage to the surface on which the load is moved. Section 4. Limits of Permit. The issuance of a per- mit does not authorize the permittee in moving a building to break, injure, damage or move public utility facilities, trees, or other public or private property without permission from the owner of such property. Section 5. Time Limit. If at the end of one year from the date of the move the building is not in a completed state and ready for occupancy, both inside and out, its owner shall within 30 days remove it from its site and shall restore the site to its condition as it existed prior to the issuance of the permit. Section 6. Penalty. Any person violating any of the provisions of this ordinance, upon conviction thereof, shall be punished by a fine not to exceed $200.00 or by imprisonment in the city jaul for a period not to exceed 60 days, or both, for each day he is in violation.
