HomeMy WebLinkAbout1793ORDINANCE NO. /7 y,3 AN ORDINANCE on installment payment on fines and repealing Ordinances No. 1617 and 1682 THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO ORDAIN AS FOLLOWS: Section 1. The City of Port Angeles hereby provides that upon a plea and proof that a person is unable to pay any fine imposed by this Code, a court may order its payment in equal monthly installments of ten dollars ($10.00) to the Court Clerk beginning thirty (30) days after the imposition of the fine until the fine is satisfied in full. Section 2. Upon default by the defendant of any such monthly installments, the entire balance of the fine shall immediately be due and payable by the defendant. Section 3. The Court, upon receipt of a report of such de- fault from the Court Clerk, shall set a date and place of hearing with proper notice to the defendant ordering the defendant to appear and show cause why he should not be imprisoned until the fine is satisfied in full Such notice shall be made either by personal service or by registered mail to the defendant at the last known address, at least five (5) days prior to the date set for the hearing. Section 4. After hearing thereon, if the evidence warrants, the Court, Magistrate or Justice of the Peace shall sentence the defen- dant to imprisonment in the County Jail or other place of legal incarcer- ation for a term not to exceed six (6) months for any one (1) offense until the fine is fully paid. Section 5. Such defendant shall be allowed a credit of ten dollars ($10.00) for each day's work within such place of incarceration on account of such fine. Section 6. Ordinances No. 1617 and No. 1682 are hereby re- pealed.
