HomeMy WebLinkAbout1908ORDINANCE NO. 070i AN ORDINANCE of the City of Port Angeles, Washington approving and confirming the assessments and assessment roll of Local Improvement District No. 198, levying assessments against the several lots, tracts and parcels of ].and as shown on the assessment roll, fixing interest and penalties, and providing for the payment of such assessments, interest and penalties into the Local Improvement District No. 198 Fund of the City. WHEREAS, the City Council of the City of Port Angeles, Washington (the "City ") provided that a hearing on the assessment roll in Local Improvement District No. 198 should be held at 7.� 3U 1; 112 o'clock p.m. on .t Y sir.,,, /6 , 1977 at ( f n; and WHEREAS, notice of such hearing was published at the times • and in the manner required by law; and WHEREAS, notice of such hearing was also mailed to the owners and reputed owners of the land in Local Improvement District No. 198 at the address shown on the tax rolls of the Treasurer of Clallam County, Washington more than 15 days prior to the date fixed for the hearing; and WHEREAS, at said hearing the City Council considered all objections to the assessment roll and determined that said objections were without merit and should be overruled except as hereinafter provided; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Port Angeles, Washington as follows: Section 1. All protests against the assessment roll in Local Improvement District No. 198 of the City are overruled and disallowed and the assessment roll as prepared by the City Engineer and on file with the City Clerk shall be and the same is hereby approved and confirmed. The amount of the assessment roll as now confirmed is $1,547,715.69. L -(�,D Section 2. Each of the lots, tracts and parcels of land appearing on the assessment roll is hereby declared to be specially benefited by the improvements constructed in Local Improvement District No. 198 in at least the amount charged against such property, and the assessments appearing against each are in pro- portion to the total assessments appearing upon the assessment roll. There is hereby levied and assessed against each such lot, tract and parcel of land the amount appearing on the assessment roll. Section 3. Each assessment or any portion thereof may be paid at any time within 30 days from the date of the first publi- cation of the notice of collection of assessments in Local Improve- ment District No. 198 without penalty, interest or costs, and thereafter the sum remaining unpaid, if any, may be paid in 10 equal annual installments, with interest on the whole unpaid sum at the rate of 7,5 % per annum. One year from the expiration of such 30 -day period and each year thereafter, one of the install- ments shall become due and shall be collected as provided by law. Annual installments may be prepaid in the manner provided by law. Section 4. The assessment roll shall be filed with the City Treasurer for collection. The Treasurer shall publish notice as required by law that the assessment roll is in her hands for collection and that any assessment or portion thereof may be paid at any time within 30 days from the date of the first publication of said notice without penalty, interest or costs. The notice of assessment shall be in substantially the following form: NOTICE OF ASSESSMENT LOCAL IMPROVEMENT DISTRICT NO. 198 PORT ANGELES, WASHINGTON Notice is hereby given that the assessment roll for the improvement of property located within Local Improvement Dis- trict No. 198, Port Angeles, Washington for the construction and installation of street improvements of the City is in my hands for collection. All or any portion of any assessment may be paid -2- • • within 30 days from (the date of the first publication of this notice) without penalty, interest or costs and the unpaid balance, if any, may be paid in 10 equal annual installments with interest thereon at the rate of ( ) per annum, or the lien of any such assessment may be discharged at any time after the first 30 days following the date of the first publication of this notice by paying the entire amount of the assessment remaining unpaid with interest thereon to the due date of the installment next falling due. Within 15 days of the first newspaper publication as provided in the foregoing section, the City Treasurer shall notify each owner or reputed owner whose name appears on the assessment roll, at the address shown on the tax rolls of the Clallam County Treasurer, for each item of property described on the list, of the nature of the assessment, of the amount of his real property subject to such assessment, of the total amount of assessment due, and of the time during which such assessment may be paid without penalty, interest or costs. Section 7. All assessments, including interest and penalties thereon, levied as authorized herein shall be paid into the Local Improvement District No. 198 Fund. Section 8.
