HomeMy WebLinkAbout1910ORDINANCE NO. 19/a AN ORDINANCE of the City of Port Angeles, Washington, providing for the improvement of a certain area within the city by the construction and installation of storm drains, grading, ballasting and paving streets and extending the water main, and all work required in connection with such improvements, all pursuant to Improvement Resolution No. 24 -76 of the city passed and approved March 2, 1977, creating a local improvement district therefor, providing for the payment of the cost of said improvements by special assessments upon the property in said District, providing for the creation of Local Improvement District No. 200 Fund and for the issuance and sale of local improvement district warrants and notes or bonds. WHEREAS, on December 1, 1976, the Council of the City of Port Angeles, Washington, adopted its Improvement Resolution No. 24 -76 declaring its intention to order the improvement of a certain area within the city by construction and installation of storm drains, grading, ballasting, and paving streets and constructing curbs and gutters therein and by doing all work required in connection therewith - which resolution fixed the date of hearing thereon for January 19, 1977 in the City Council Chambers in Port Angeles, Washington; and WHEREAS, SAID hearing was held on January 19, 1977 as provided in said notice, and after discussion of-said improvements and due consideration thereof, the Council determined to continue the hearing until further improvement proposals could be considered; and WHEREAS, on March 2, 1977, the Council of the City of Port Angeles, Washington, amended Improvement Resolution No. 24 -76 declaring its intention to order the improvement of a certain area within the city by the construction and installation of storm drains, grading, ballasting, and paving streets and extending the water main therein, and all work required in connection there- with; and WHEREAS, said Resolution 24 -76 and Amended Resolution 24 -76 were duly published in the manner required by law and notice of said hearing was also duly given by mailing as required by law; and WHEREAS, said hearing was held on January 19, 1977 as provided in said notice, and was continued until March 2, 1977, an explanation of the proposed improvements was given by the City Manager, and after discussion of said improvements and due consideration thereof, the Council has determined to order the construction and installation of the improvements hereinafter more particularly described and to create a local improvement district there- fore; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Port Angeles as follows: Section 1. The following described area within the city shall be improved by the construction of storm drains, grading, ballasting, and paving streets and extending the water main, together with all appurtenances anc work required in connection therewith: That street known as Valley Street, and benefiting the area as described: Beginning at a point 290 feet east of the centerline of Valley Street on the north margin of Second Street; thence southerly parallel to the centerline of Valley Street to the south margin of the 12th /13th alley; thence westerly along the south margin of the 12th /13th alley, a distance of 580 feet; thence northerly parallel to the centerline of Valley Street to the north margin of Second Street; thence easterly along the north margin of Second Street, a distance of 580 feet to the point of beginning. Section 2. The following described streets, storm culverts, and water main extension shall be constructed and installed within the area described in Section 1 above, together with all necessary appurtenances and by doing all work necessary in connection therewith: 1. Three 8" storm culverts across Valley Street. 2. Grade, ballast, and pave with asphalt concrete Valley Street, from Second Street to the 12th /13th alley. 3. Extend water main to the south from 8th Street. Section 3. The plans and specifications for the improvements described in Section 2 above as prepared by the City Engineer and now on file are hereby adopted and approved. Section 4. There is hereby established a local improvement district of the city to be known as "Local Improvement District No. 200" which said district shall include all the property described in Section 1 above. -2- Section 5. The estimated cost of said improvements is $48,828.62, all of which shall be borne by and assessed against the property within Local Improvement District No. 200 specially benefited by said improvements. Such assessments shall be made against the property within the said local improvement district in accordance with the special benefits said property will derive from said improvements employing the zone and termini method; provided, however, that no assessment shall be made against the property lying east of the line denominated as "toe of the slope" and running generally parallel to Valley Street and on the east side of such street, nor shall an assessment be made against the property lying west of the line denominated as "toe of the slope" and running generally parallel to Valley Street on the west side of such street; provided further, that all property located on the east side of Valley Creek and south of the centerline of Sixth Street shall be deemed to be and shall be assessed as included in the fifth sub- division or zone of the improvement district with regard to the zone and termini method. Section 6. There is hereby created a fund of the city to be known as "Local Improvement District No. 200 Fund" into which fund there shall be paid all of the assessments collected in said district as and when directed by the ordinance confirming said assessment and the assessment roll therefor. Interim revenue warrants bearing interest at a rate to be fixed by the City Council shall be drawn upon said fund based upon estimates of the City Engineer and shall be sold to such person, firm or corporation or to such other funds of the city as may hereafter be provided by resolution of the City Council and in the manner provided by such resolution to furnish moneys for the payment of the costs of construction and installation of said improvements and costs incidental thereto as the same shall be incurred. The proceeds of sale of such interim revenue warrants shall be deposited in said fund and cash warrants drawn thereon in payment of such costs. Upon completion of the improvements and after the expiration of the 30 -day assessment prepayment period, installation notes of said local improve- ment district bearing interest at a rate of not to exceed 1.6'% per annum payable -3- on or before ten years from date of issue shall be issued for the redemption of the outstanding revenue warrants and shall be payable both principal and interest by the collection of special assessments to be levied and assessed upon the property within the district payable in ten equal annual installments with interest at a rate of not to exceed %5 % per annum, all as provided by law and ordinances of the city. Section 7. This ordinance shall become effective five days from and after its passage, approval and publications. PASSED by the Council of the City of Port Angeles, and approved by its Mayor at a regular meeting of said Council held this 16th day of March, 1977.
