HomeMy WebLinkAbout1917• 1 CITY OF PORT ANGELES, WASHINGTON ORDINANCE NO. /977 AN ORDINANCE vacating that portion of Eunice Street between Rose Street and Rhodes Road. WHEREAS, a petition is on file with the City of Port Angeles to vacate that portion of Eunice Street between Rose Street and Rhodes Road; and WHEREAS, all of the legal requirements have been met including the holding of a public hearing thereon by the City Council following public notice pursuant to RCW Chapter 35.79; and WHEREAS, said vacation appears to be of benefit to and in the interests of the public; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS: Section 1. That portion of Eunice Street described below is hereby vacated: That portion of Eunice Street abutting Blocks 2 and 3 of Fogarty and Dolans Second Addition to the City of Port Angeles, according to the plat recorded in Volume 3 of Plats, page 65, records of Clallam County, Washington, from the northerly line of Rose Street to the northerly line of Blocks 2 and 3. Pursuant to RCW 35.79.030, the City reserves the right to exercise and grant easements over the vacated portion of said street for the construction, repair, and maintenance of public utilities and services. Said vacation shall become effective upon the granting of an easement for street and utility purposes to the City of Port Angeles over the following described property: The south half of Rhodes Road adjacent to Lots 1, 2 and 3, Block 3, Fogarty & Dolans Second Addition and adjacent to Lots 9 through 16, Block 2 of said plat; together with The north half of Rose Street adjacent to Lots 17 through 24, Block 2 of Fogarty & Dolans Second Addition. Section 2. Upon the request for and furnishing of a quit claim deed by any owner of property abutting upon the vacated portion of said street, the mayor is hereby authorized and directed to execute such quit claim deed, provided that the easement above described in Section 1 of this ordinance has been conveyed to the City. Section 3.
