HomeMy WebLinkAbout1935AI ORDINANCE NO. f9.5 AN ORDINANCE providing for the adoption, administration, and enforcement of portions of the State Building Code and repealing any Ordinances of the City or portions thereof in conflict therewith. BE IT ORDAINED by the City Council of the City of Port Angeles as follows: Section 1: This Ordinance shall be known as the Building Code of the City of Port Angeles. Section 2: Pursuant to the State Building Act. Ch. 96, Laws of 1974 1st Ex. Sess., enacted by the Washington State Legislature the following codes are hereby adopted subject to the amendments hereinafter set forth in Section 3 of this Ordinance. (A) Uniform Building Code and Related Standards, 1976 Edition with Appendices, published by the International Conference of Building Officials; (B) Uniform Mechanical Code, 1976 Edition, including Chapter 22, Fuel Gas Piping, Appendix 'B', published by the International Association of Plumbing and Mechanical Officials and the Inter- national Conference of Building Officials; (C) "Washington State Barrier -Free Design Standards ", Chp. 110 Laws of 1975, eff. date Oct. 1, 1976. (D) Uniform Sign Code, 1976 Edition, published by the International Conference of Building Officials; (E) Uniform Housing Code, 1976 Edition, published by the Inter- national Conference of Building Officials; (F) Dangerous Buildings Code, 1976 Edition, published by the International Conference of Building Officials; (G) Uniform Plumbing Code, 1976 Edition, published by the Inter- national Association of Plumbing and Mechanical Officials, with appendices, installation standards and as amended. In case of conflict among the Codes enumerated in Sub - sections (A), (B), (C), (D), (E), (F), and (G) of this section, the first named code shall govern over those following. Section 3. Pursuant to Section 4 and Subsection (3) and (4) of Section 6 of the State Building Code Act, Ch. 94, Laws of 1974, 1st Ex. Sess., and Section 2, above, the following amendments to the Uniform Building Code, Uniform Sign Code and Uniform Plumbing Code are hereby adopted: Volume 1, Table 5 -A (Page 54) of the Uniform Building Code and related Standards 1976 Edition, following the sentence "For Types I, II F.R. and III and IV Construction see Sections 1803, 1903 and 2103" add the sentence "See Section 1603(d) for Exterior Wall protection of buildings located in Fire Zone No. 2 ". Volume I page 99 in Section 1603 add a subsection "(d) "Exterior Wall Protection. Exterior walls less than twenty feet (20') from an adjacent property line shall be not less than two -hour fire resistive construction ". Volume I Section 2003 (Page 119) following the sentence "For fire protection of exterior walls and openings as determined by location on property, see Sec. 504 and Table 5 -A" add "See Section 1603(d) for exterior wall protection of buildings located in Fire Zone No. 2 ". Volume I, Section 2003 exception 2 (Page 119) following the sentence ". . . less than 20 feet from a property line in Fire Zone No. 1 and 10 feet from a property line in Fire Zone No. 2 ". Add "See Section 1603(d) for exterior wall protection of buildings located in Fire Zone No. 2 ". Volume I, Section 2103(a) (Page 121) following the sentence "Exterior walls of Types III and IV buildings shall be constructed of non - combustible materials and shall comply with the fire - resistive requirements set forth in Section 504 and Table 17 -A" add "See Section 1603(d) for exterior wall protection of buildings located in Fire Zone No. 2 ". Volume I, Section 2203 (Page 125) following the sentence "For fire protection of exterior walls and openings as determined by location on property, see Section 504 and Table No. 5 -A ", add "See Section 1603(d) for exterior wall protection of 'buildings located in Fire Zone No. 2 ". Uniform Sign Code, Chapter 3, Sec. 301 is amended by adding thereto the following wording "Provided that presently existing signs not in conformity with the Code, as amended, may be maintained in their present condition unless hazardous, but may not be altered or reconstructed unless in conformity with this Code". Uniform Sign Code, Chapter 3, Sec. 304 is amended to read as follows: "A sign permit fee and plan - checking fee shall be paid in accordance with the following schedule: Under $100 $10 $100 to $500 $20 Over $500 to $1,000 $30 Over $1,000 $50 Any person, firm, or corporation who shall erect, re- erect, construct, alter, or maintain a sign without a permit first having been obtained, except as provided by this Code, shall as a penalty pay double the amount of the fee due for signs in the above named schedule ". Uniform Sign Code, Chapter 4, Sec. 403, Table 4 -B is amended by substituting Chapter 45, Section 4505(b) (Page 601) of the Uniform Building Code, 1976 Edition, Volume I as adopted, in place of Table 4 -B. In calculating the number of persons, Table 33 -A Vol. I of the Uniform Building Code will be used as the basis. 2Building category not shown on this table shall be considered separately by the Administrative Authority. 3Drinking fountains shall not be installed in toilet rooms. ** 4Laundry trays - 1 laundry tray or 1 automatic washer standpipe for each dwelling unit or 2 laundry trays or 2 automatic washer standpipes (or combina- tions thereof) for each 10 apts. Kitchen sinks - 1 for each dwelling or apt. unit. 5This schedule has been adopted (1945) by the National Council on Schoolhouse Construction. 6As required by the American Standard Safety Code for Industrial Sanitation in Manufacturing Establishments (ANSI 74.1- 1942). 7 Where there is exposure to skin contamination with poisonous, infectious, or irritating materials, provide 1 lavatory for each 5 persons. 824 lineal inches of wash sink or 18 inches of a circular basin, when provided with water outlets for such space, shall be considered equivalent to 1 lavatory. 9Laundry Trays - 1 for each 50 persons. Slop sinks, 1 for each 100 persons. 10(a) Trough urinals are prohibited (b) Wall -type trough urinals shall be acid resistant and each such urinal shall be not less than six (6) inches deep and shall be furnished with one -piece backs and have strainers with outlets at least one and one -half (12) inches in diameter. The washdown pipe shall be perforated so as to flush with an even curtain of water against the back of the urinal. Urinal tanks shall have a flushing capacity of not less than one and one -half (11/2) gallons of water for each two (2) feet of urinal length. (c) Equivalent length- Trough urinals shall be figured on the basis of one urinal for each eighteen (18) inches of length, provided that - Length of Urinal 24" 36" 48" 60" 72" Equivalent No. Urinals 1 2 2 3 4 (d) Surrounding materials - Wall and floor space to a point one (1) foot in front of urinal lip and four (4) feet above the floor, and at least one (1) foot to each side of the urinal shall be lined with non - absorbent material. General - In applying this schedule of facilities, consideration must be given to the accessibility of the fixtures. Conformity purely on a numerical basis may not result in an installation suited to the need of the individual establishment. For example, schools should be provided with toilet facilities on each floor having classrooms, Temporary Workingmen Facilities - 1 water closet and 1 urinal for each 30 workmen. Length of Urinal 24" 36" 48" 60" Equivalent No. Urinals 1 2 3 4 11A restaurant is defined as a business which sells food to be consumed on the premises. (a) The number of occupants for a drive -in restaurant shall be considered as equal to the number of parking stalls. (b) Employee toilet facilities are not to be included in the above restaurant requirements. Hand washing facilities must be available in the kitchen for employees. 12Where food is consumed indoors, water stations may be substituted for drinking fountains. Theaters, Auditoriums, Dormitories, Offices of Public Buildings for use by more than six (6) persons shall have one drinking fountain for the first one hundred (100) persons and one additional fountain for each two hundred (200) persons thereafter. 13Required restroom facilities shall be maintained open and operable during business hours where businesses are being conducted and in other buildings when being used by employees, occupants or the public. ** See drinking fountain requirements #12. Section 4. Ordinance No. 1835 and Chapter 14.04 of the Municipal Code, and Ordinance No. 1836 and sections 14.16.010 through 14.16.050 inclusive of the Municipal Code are hereby repealed. Section 5. It shall be unlawful for any person, firm, or Corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy, or maintain any building or structure in the City, or cause the same to be done, contrary to or in violation of any of the provisions of this Ordinance. Section 6. Notwithstanding the provisions of Section 205 of the Uniform Building Code and Section 202 of the Uniform Mechanical Code, any person, firm, or corporation, violating any of the provisions of this Ordinance shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Ordinance is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500 or by imprison- ment for not more than 6 months or by both such fine and imprisonment. Section 7: If any provision of this Ordinance, or of the codes eferred to herein, or its application to any person or circumstance is held nvalid, the remainder of the ordinance, or the application of the provision o other persons or circumstances is not affected.
