WHEREAS Port Angeles City Ordinance No . 1968 failed to make provision for seasonal variations in the personnel require- ments of private security businesses; and WHEREAS it is recognized that the safety of the public can be adequately protected by a limited reduction in the scope of the screening of registrants in certain circumstances; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO ORDAIN AS FOLLOWS: Section 1. The following subsections are hereby added to section 1 of Ordinance 1968, the remainder of the section being unchanged: "(k) 'Permanent employee' shall include all personnel employed by a private security licensee for more than forty -five calendar days in any year. (1) 'Temporary employee' shall include all personnel employed by a private security licensee for less than forty -six calendar days in any year." Section 2. Section 6 of Ordinance 1968 heretofore pro- viding as follows: "Section 6. Background Check. Each person, as defined in this ordinance will be subject to a background check, as determined by the Chief of Police through the depart- ment of police. The department of police shall send a letter to the City Clerk concerning the background of the applicant, which may contain any objection or recom- mendation as to the application. The Chief of Police may require fingerprinting or photographs of all appli- cants for any licensee described in this ordinance." -1- r" 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 is hereby amended to read as follows: "Section 6. Background Check. Each person, as defined in this ordinance will be subject to a background check, as determined by the Chief of Police through the department of police. In the case of persons applying for registration as tem- porary employees of a registrant, the background check may be limited to an examination of the records of only those law enforce- ment agencies located within Clallam County. The department of police shall send a letter to the City Clerk concerning the back- ground of the applicant, which may contain any objection or recom- mendation as to the application. The Chief of Police may require fingerprinting or photographs of all applicants for any licensee described in this ordinance." Section 3. The following subsection is hereby added to Section 23 of Ordinance 1968, the remainder being unchanged: "(c) The application for registration of temporary employees under the provisions of this ordinance shall include, in addition to the data required under subsection (b), above, the following: (1) The length of time during which the applicant has continuously been a resident of Clallam County; and (2) Any other data as may be required by the City Clerk which in the opinion of said Clerk indicates the appli- cant's ties to the community." Section 4. A second paragraph is hereby added to Section 26 of Ordinance 1968, the remainder of which shall be un- changed: "The City Clerk shall refuse to register for employment as a temporary employee any applicant who has not been a resident within Clallam County, Washington, continuously for longer than -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 28 27 28 29 30 31 32 five years immediately preceding the date of said application for registration." Section 5. Section 29 of Ordinance 1968, heretofore providing as follows: "Section 29. Registration - Fee. The registration fee for employees of a licensee is fixed as follows: Twenty -five (25) dollars per year; Fifteen dollars (15) for renewal thereof." is hereby amended to provide as follows: "Section 29. Registration - Fee. The registration fees for emloyees of a licensee are fixed as follows: (a) Permanent employees: Twenty -five ($25) Dollars per year and Fifteen ($15) Dollars per year for renewal thereof; (b) Temporary employees: Seven ($7) Dollars, renewal of which is hereby prohibited; PROVIDED, however, that in the event that a temporary employee applies for registration as a permanent employee of any licensee within one year of registration as a tem- porary employee, the City Clerk shall deduct from the initial fee for registration of permanent employees such fee as was previously collected from the applicant, allowing a credit therefor against such initial fee."
