HomeMy WebLinkAbout2022"G 9 57', IT GOO ORDINANCE NO. 0?0�a AN ORDINANCE of the City of Port Angeles providing insurance requirements for the moving of buildings, and requiring com- pliance of moved structures with building codes before sale, amending Section 14.32.010 and 14.32.050 of the Code of the City of Port Angeles. 9 THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. Section 14.32.010 of the Code of the City of Port Angeles is amended to read as follows: 14.32.010 Permit -- Required - -Fee. In addition to the requirements of the Uniform Building Code in effect in the city regarding the moving of buildings, every person, firm or corporation desiring to move a building shall: A. Notify public utility companies controlling or maintaining telephone, telegraph, or other overhead wires in the city at least one week before the moving date, indicating the applicant's inten- tion to move a building or part thereof, the proposed route, and the date of moving; B. At the time of applying for a permit, the applicant shall submit to the building official a letter or other written notifi- cation from the public utility companies stating the time they were notified of the proposed moving of the building, and a sketch of the proposed route; C. The permittee shall: 1. Conform to all requirments which are now or may be hereafter established by the city council, and 2. Promptly repair and make good to the satisfaction of the city engineer any damage to pavement, sidewalks, crosswalks, hydrants, sewers, water lines, streets, alleys, or other public or private property done or caused by the applicant, his employees, or agents in moving a building or part of a building, April 27, 1979 MEMORANDUM TO: City Council /Manager FROM: City Attorney RE: Amendment of Moving Contractor Ordinance Attached is a proposed ordinance amending the moving of buildings ordinance, to deal with two problems which have arisen with this ordinance in the recent past. First, several persons have raised the complaint that the ordinance requires the applicant for permit to have insur- ance, rather than allowing the insurance of the moving contractor to be available. This results in a double in- suring, as the moving contractor is required to have such insurance for his contractor's license. The interest which this insurance is designed, presumably, to protect is that of the public in seeing that the moving of the building, involving traffic obstructions and other hazards, is an insured activity. This amendment would simplify that sit- uation. The second amendment is designed to avoid the situation in which a person can move a house, and then sell it, before it is returned to usable condition. The Building Department has requested this amendment, as some sales of moved build- ings have occurred before they are restored to an occupancy condition, and there has been some confusion on the part of purchasers of those buildings. 3. File with the city treasurer a certificate of insur- ance certifying applicant or the applicant's moving contractor as the named insured under a comprehensive public liability policy of insurance with a reputable insurer, with minimum policy limits of fifty thousand dollars and one hundred thousand dollars for bodily injury, and twenty -five thousand dollars for property damage, 4. Pay the city treasurer five hundred dollars for a permit to move a building. Provided that four hundred and fifty dollars of the permit fee shall be refunded to the permittee if within one year after the date on which the building was moved, the building moved complies with all applicable city ordinances, rules and regulations, and is in a completed state. Section 2. Section 14.32.050 of the Code of the City of Port Angeles is amended to read as follows: 14.32.050 Time limit - -Site restoration. If at the end of one year from the date of the move, or prior to sale or occupancy of the building, whichever is sooner, the building is not in a com- pleted state and ready for occupancy, both inside and out, its owner shall, within thirty (30) days remove it from its site and restore the site to its condition as it existed prior to the issurance of the permit.
