HomeMy WebLinkAbout20491 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. p20419 AN ORDINANCE of the City of Port Angeles, Wash - ington, providing for the improvement of the downtown area of the city by making sidewalk improvements, landscaping beautification and providing street furniture, and by doing all other work required in connection with such improvements, all pursuant to Resolution No. 35 -79 of the City passed and approved on October 2, 1979; creating a local improve- ment district therefor, providing for the payment of a portion of the cost of said improvements by special assessments upon the property in said District, providing for the creation of Local Improvement District No. 203 and for the issuance and sale of local improvement district warrants and notes or bonds. WHEREAS, on October 2, 1979, the Council of the City of Port Angeles, Washington, adopted its Resolution No. 35 -79 declaring its intention to order the improvement of a certain area within the city generally known as the downtown area by making sidewalk installations, sidewalk beautification, street - side landscaping and beautification, providing street furniture, and doing all work required in connection therewith; and WHEREAS, said resolution was duly published in the Port Angeles Daily News in the manner required by law and notice of said hearing was also duly given by mailing as required by law; and WHEREAS, said hearing was held on December 18, 1979, as provided in said notice, various oral statements for and against the improvements were made and certain written protests were filed and after discussion of said improvements and due considera- tion thereof the Council has determined to order the construction and installation of the improvements hereinafter more particularly described and to create a local improvement district therefor; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 410 27 28 29 30 31 32 NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Port Angeles, Washington, as follows: Section 1. The property within the city described in Exhibit A, attached hereto and incorporated by reference herein, shall be improved by doing sidewalk installation where none exist, sidewalk beautification, street -side landscaping and beautification, providing street furniture, and doing all other work necessary in connection with such improvements, complete with all necessary and desirable appurtenances and facilities, all as set forth in preliminary plans therefor, prepared by Clark & Associates, Port Angeles, Washington, and now on file with the city. The city shall acquire by gift, purchase, lease or condemna- tion all property, both real and personal, or any interest therein and all rights of way, permits and easements, if any, which may be found necessary to acquire, construct and install the above - described improvements. The hereinabove authorized plans of improvement shall be subject to such changes as to details of said plans not affecting the main general plan as shall be authorized by the City Council either prior to or during the actual course of construction. Such plan of improvements shall not be carried out until the requirements of the State Environmental Protection Act have been complied with, and shall be implemented or modified only after consideration by the city of the information developed in the course of such compliance. Section 2. The preliminary plans and specifications for the improvements described in Section 1 above as prepared by Clark & Associates and contained in the report of said firm now on file with the city, are hereby adopted and approved. Section 3. There is hereby established a local improvement district of the city to be known as "Local Improvement District -2-- 1 2 3 4 • 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 No. 203" which said district shall include all the property described in Exhibit A. Section 4. Approximately 100% of the entire cost of the improvements shall be borne by and assessed against the property within Local Improvement District No. 203 specially benefited by said improvements. Section 5. There is hereby created a fund of the city to be known as "Local Improvement District No. 203 Fund," into which fund there shall be paid all of the assessments collected in said district as and when directed by the ordinance confirming said assessments and the assessment roll therefor. Interim revenue warrants bearing interest at a rate of not to exceed the maximum rate permitted by law shall be drawn upon said fund based upon estimates of the City Engineer and shall be sold to such persons, firm or corporation or to such other funds of the city as may hereafter be provided by resolution of the City Council and in the manner provided by such resolution to furnish moneys for the payment of the costs incidental thereto as the same shall be incurred. The proceeds of sale of such interim revenue warrants shall be deposited in said fund and cash warrants drawn thereon in payment of such costs. Upon completion of the improvements and after the expiration of the 30• -day assessment prepayment period, installment notes or bonds of said local improvement district bearing interest at a rate of not to exceed the maximum rate permitted by law and pay- able at such time or times as are hereafter fixed by ordinance shall be issued for the redemption of the outstanding revenue warrants and shall be payable both principal and interest by the collection of special assessments to be levied and assessed upon the property within, the district payable with interest at a rate not to exceed the maximum rate permitted by law, all as provided by law and ordinances of the city. If bonds are issued they 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 shall be in the denomination of $5,000 each, except for Bond No. 1, the denomination of which shall be hereafter provided by ordinance of the City Council. Section 6. This ordinance shall become effective five days after its passage, approval and publication.
