WHEREAS, the necessary public hearings have been held; and WHEREAS, the requirements of Title 35A. RCW and Chapter 43.21C RCW have been met and a public hearing has been held by the City Council following public notice; and WHEREAS, the City Council finds it to be in the best interests of the City of Port Angeles; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Section 12 of Ordinance No. 1588, as amended is hereby amended to read as follows: Section 12. USE OF PARKING SPACES. Subsequent to the issuance of a building permit after compliance with this ordinance, the number and location of parking spaces used to satisfy the requirements of this ordinance shall not be changed, nor shall the use of the building or structure for which the permit is issued be changed, without the is- suance of a revised building permit, which issuance shall be in accordance with this ordinance. Parking spaces used by a land use to satisfy the requirement of this ordinance shall only be used for the parking of vehicles of cus- tomers and other users of the building and land use authorize by the building permit, and any permanent change in this use from that purpose shall require a revised building permit. Section 2. There is hereby created a new Port Angeles Municipal Code, to be known as Chapter Lot Activities. Section 3. A parking lot activity is a non - permanent activity occurring in a parking lot, using spaces otherwise allocated for parking for purposes other than parking, by clientele of the primary use of the prop- erty. Section 5. Section 11.20.020 PERMIT REQUIRED. Any park ing lot activity must have a permit which complies with the provi- sions of this Ordinance. Section 6. Section 11.20.020 DEVELOPMENT STANDARDS. All parking lot activities shall comply with the following stan- dards: 1 2 4 7 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 No such activity shall occur in parking spaces directly in front of entrances or windows of a building. Such activities shall not occupy more than 10% of the total number of spaces in the parking lot. Such activities shall not block entrances and exits to the parking lot or fire exit doors of any buildings. Such activities shall only occur in parking lots containing more than 20 spaces. All such activities shall provide the City with a hold harm- less agreement. All such activities shall comply with all other applicable City Ordinances and State Statutes. Each permit shall be for a period not to exceed one (1) week for private businesses and four (4) weeks for private non- profit and charitable organizations. Reapplication for ad- ditional time is permitted; provided, however, that only one reapplication may be submitted per calendar year. The location and activity shall not endanger the public healt morals, safety and welfare. Section 7. Section 11.20.040 APPLICATION PROCEDURE. The application for a Parking Lot Activity permit shall be sub- mitted on a form obtained from the Public Works Department and accompanied by documents certifying that the property owners and contiguous businesses have been notified of the application and requested activity. Section 8. Section 11.20.050 ROUTING AND STAFF DETER- MINATION. Upon receipt of an application satisfying the require- ments of Section 11.20.040, the Public Works Department shall route the same to all appropriate departments. Each such depart- ment shall submit to the Public Works Department recommendations and comments regarding the application. On receipt of said recommendations and comments, the Public Works Director shall make a determination whether to approve, deny, or approve with modifications or conditions the permit, according to the standards of this Ordinance. Section 9. Section 11.20.060 PERMIT NOT TRANSFERABLE. Once a Parking Lot Activity permit has been issued, it shall not be transferred to another person or to a location other than that stated on the permit. Section 10. Section 11.20.070 PENALTY. Any person violating any provision of this Ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed Five Hundred ($500) Dollars. Each day that a violation continues shall constitute a separate offence. Each activity that violates this Ordinance shall constitute a separate offence. Section 11. Section 11.20.080 SEVERABILITY. If any provisions of this Ordinance, or its application to any person or circumstance, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. -2- • • 1 Section 12. Section 11.20.090 EFFECTIVE DATE. This Ordinance is necessary for the preservation of the public health, 2 safety and welfare, and a public emergency exists.
