THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. Purpose and Findings. The City Council of the City of Port Angeles finds that it is appropriate and necessary for the City of Port Angeles to provide a credit against utility charges to low income elderly residents of the City. The Council further finds that this credit can be accompanied by energy con- servation programs, the implementation of which will benefit the City of Port Angeles and its citizens through a reduction in demand of utility services. Section 2. Definitions. A. "Energy Credit" - A credit granted pursuant to the terms of this ordinance to a low- income senior citizen, the amount of which is applied against outstanding obligations of the citizen to the City of Port Angeles for utility services. B. "Low- Income Senior Citizen" - A person who: (i) resides within the City of Port Angeles; (ii) is over sixty years of age; (iii) receives utility services from the City of Port Angeles (iv) is the head of a household; (v) whose gross household income is less than 80% of the Washington State median income, adjusted for family size. C. "Gross Household Income" - All income, including social security, pensions, contract rights, salary or wages, interest on investments, dividends, or of any other kind; which is received by a person who resides in the same dwelling unit and who is served by the same utilities as the person who is the recipient of an energy credit. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 D. "Washington State Median Income Adjusted for Family Size" - That statistic, current on the date of grant of an energy credit, which is published and calculated by the Washington State Office of Financial Management, and which establishes the median income for residents of Washington, adjusted for family size. Section 3. Energy Credit. There is hereby authorized an energy credit for each calendar year commencing January 1, 1981, which credit shall be granted to qualified low - income senior citizens, in accordance with the terms of this ordinance. Section 4. Information to be Made Available. The City Clerk of the City of Port Angeles shall maintain at all times, the following information which shall be current and applicable to current applications for, and awards of, energy credits under the terms of this ordinance: A. The Washington State median income, adjusted for family size, which shall be used to calculate energy credits to be granted in any particular year; B. A list of all federal, state or local energy related programs which are available to provide fiscal assistance to low - income senior citizens, for which certification of application must be made by an applicant; C. A list of all conservation or consumption reduction programs of the City of Port Angeles, for which an applicant for an energy credit must agree to apply, and the requirements of each such program; D. Current application forms. Section 5. Qualifications for Energy Credit. Each recipient of an energy credit must meet the following criteria: A. Certify that he or she has completed an application for and has either received or been denied, aid for all federal, state or local energy related programs available to provide fiscal assistance to low- income senior citizens. C. (i) Agree to participate in a conservation or con- sumption reduction program; (ii) Failure of the applicant to comply with a require- ment of a conservation or consumption reduction program, after receipt of an energy credit, shall constitute the basis for denial by the City of participation in the energy credit program during ensuing years. Section 6. Application for Credit. A. Applications for annual energy credits shall be filed with the City Clerk not later than the 25th day of January of the year for which the credit is desired. Applications shall be for one year only and must be renewed on an annual basis. B. The City may provide an application period for semi- annual energy credits, to terminate on the 25th day of June, during any single calendar year. The determination of whether to provide such an application period shall be based upon fund- ing of the program by the City Council. Application for, quali- fication for, and payment of any semi - annual energy credit shall be in accordance with the requirement of this ordinance. C. The City Clerk of the City of Port Angeles shall publish a notice in a newspaper of general circulation within the City of Port Angeles, not less than fifteen (15) days prior to the closing date for receipt of applications for energy credits. Such notice shall state that such program is available, that application must be received by the City of Port Angeles not later than the date stated in this ordinance, and shall provide directions for the filing of such application. -3- 1 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 D. Submission of an application for an energy credit shall constitute a verification by the applicant that all information provided in such application is true and correct, to the best of the applicant's knowledge. Section 7. Calculation of Credit. Calculation of the amount of the energy credit for eligible low- income senior citizens shall be in accordance with the following procedure: A. The total amount appropriated by the City Council for any single calendar year shall be pro -rated among three classes of citizens, based upon the total number of applications received and the number of applications received in each group. Such proration shall be done by the City Council, by resolution. The three classes shall be as follows: (i) Group I shall consist of persons whose gross house- hold income does not exceed 38% of the State median income adjusted for family size. (ii) Group II shall consist of applicants whose gross household income is greater than 38% but does not exceed 57% of the State median income adjusted for family size. (iii) Group III shall consist of applicants whose gross household income is greater than 57% but does not exceed 80% of the State median income adjusted for family size. B. Within each such group, the amount credited to each eligible low- income senior citizen will be based upon applicant's gross household income. Subsequent to the closing date for the receipt of applications, the City Council of the City of Port Angeles will approve, by resolution, a list of gross household income ranges within each Group, and the amount of an energycredi -4- • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 • 22 23 24 25 26 27 28 29 30 31 32 to which each income range is entitled; provided, that no energy credit shall exceed One Hundred ($100.00) Dollars for persons in Group I, Fifty ($50.00) Dollars for persons in Group II, nor Twenty -five ($25.00) Dollars for persons in Group III. C. The amount of credit to be received by any individual shall be reduced by the sum of the percentage of State median income adjusted for family size establishing the Group to which they belong, and the amount of aid, if any, received by the appli- cant from another federal, state or local program providing assistance to low - income senior citizens, for which certification of compliance is required by the terms: of this ordinance. Section 8. Payment of Credit. An energy credit calcu- lated pursuant to the terms of this ordinance shall be applied to utility charges for electricity, water, sewer or solid waste services levied by the City of Port Angeles against the eligible low- income senior citizens during the calendar year for which the credit is granted. Section 9. Penalty for False Information. The wilful provision to the City of Port Angeles of false information in an application for energy credit shall forfeit the low - income senior citizen's eligibility for future credits. Additionally, the low - income senior citizen shall be required to repay the amount of any energy credit received based upon such false information. Section 10. Effective Date. This ordinance shall take effect on the first day of January, 1981.
