HomeMy WebLinkAbout2126• • 2 7. .a 3. gl ORDINANCE NO. /it�i AN ORDINANCE of the City of Port Angeles establishing solid waste collection fees, imposing an in lieu tax to the solid waste utility, amending Section 12 of Ordinance 1327, Ordinance 1851, and Section 8.12.040 of the Port Angeles Municipal Code; repealing Section 13 of Ordinance 1327 and Section 8.12.050 of the Port Angeles Municipal Code, and adding a new chapter and section to Title 3 of the. Port Angeles Municipal Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Section 13 of Ordinance No. 1327, Ordinance 1851, and Section 8.12.040 of the Port Angeles Municipal Code are each amended to read as follows: 8..12.040 Rate -- Schedule. A. Rates for the collection of garbage, trash, refuse and offal shall be the sum of four dollars per month for the first can. There shall be no additional charge for a second can. There shall be a charge of one dollar for each additional can beyond two cans. As used in this section, "can" shall be as defined in Section 8.12.080 of the Port Angeles Municipal Code. B. Rates for the collection of refuse other than in cans are as follows: CAPACITY 'MONTHLY RENTAL PICKUP RATE CARE (Each pickup) 1 yd. $ 8.00 $3.00 12 yd. 10.00 4.00 2 yd. 12.00 5.00 3 yd. - 7.50 C. Except for those sunken cans existing on April 1, 1975, sunken cans are prohibited in the City of Port Angeles. Section 2. Section 13 of Ordinance No. 1327 and Section 8.12.050 of the Port Angeles Municipal Code are hereby repealed. Section 3. There is hereby added to Title 3 of the Port Angeles Municipal Code a new chapter, entitled UTILITY IN LIEU TAX, and a new section is added to that chapter, as follows: • • Solid Waste Utility In Lieu Tax. There is hereby imposed an in lieu tax on the solid waste utility fund. Such tax shall be equivalent to five (5 %) percent of the gross sales receipts of the solid waste utility, and shall be payable to the Municipal General Fund in monthly installments. Section 4. Severablility. If any provisions of this ordinance, or its application to any person or circumstance is held invalid, the remainder of the ordinance, or application of the provisions of the ordinance to other persons or circumstances, is not affected. Section 5. This ordinance shall take effect five (5) days after publication.
