ORDINANCE NO. a/ 3 3 AN ORDINANCE of the City of Port Angeles adopting by reference Title 46, RCW, as now existing, and all future amendments, additions, and new sections, adding a new chapter to Title 10 of the Port Angeles Municipal Code and repealing Ordinance No. 1180. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES, as follows: Section 1. There is hereby added to Title 10 of the Port Angeles Municipal Code, a new section to be placed in Chapter 1'0'.04; titled the Motor Vehicle Code; as follows: 10.04.010 Adoption: Title 46, RCW, Motor Vehicles, as now existing and all future amendments, additions, and new sections, are hereby adopted by reference as the Motor Vehicle Code of the City of Port Angeles as provided in RCW 35A.12.140. Section 2. There is hereby added to Title 10 of the Port Angeles Municipal Code, a new section to be placed in Chapter10.04, titled the Motor Vehicle Code, as follows: 10.04.020 Penalties; Not withstanding any provision to the contrary adopted in 10.04.010 of this chapter the maximum penalty for a violation of any provision adopted in Section 10.04.010 shall be 90 days or a $500 fine or both such imprisonment and fine. Such violation shall be considered a simple misdemeanor. Section 3. If any provision of this ordinance, or any pro- vision of any statute adopted by reference by this ordinance, or their application to any person or circumstance is held invalid, the remainder of this ordinance, or the application of the provi- sion to other persons or circumstances is not affected, and to this end the provisions of this ordinance are declared to be severable. Section 4. Ordinance No. 1180 is hereby repealed. Section 5. This ordinance shall take effect April 1, 1981. Miller, City Attorney RE: Proposed Ordinance Adopting Title 46, RCW The attached ordinance clarifies an ambiguity which has arisen in regard to the existing City ordinance adopting Title 46, RCW (Motor Vehicles). That ordinance does not include language adopting all amendments to that statute. As this point has been raised, albeit unsuccessfully, in several cases, its seems prudent to correct this error by adopting an ordinance which clearly adopts all amendments to Title 46, RCW, as a portion of the City's motor vehicle code.
