HomeMy WebLinkAbout2205e,C, 701.e 1&30 y. y7 Pico ORDINANCE NO. .2O5 AN ORDINANCE of the City of Port Angeles vacating the west 150 feet of Fourth Street east of Peabody Street. WHEREAS, a petition is on file with the City of Port Angeles to vacate the entire Fourth Street right -of -way between Peabody Street and Vine Street; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, have been met and a public hearing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, vacation of the west 150 feet of said Fourth Street is of benefit to and in the interest of the public; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Vacation. Subject to the terms and conditions of this Ordinance, the following described portion of Fourth Street is hereby vacated: That portion of Fourth Street abutting the southerly line of Lots 10, 11 and 12, Block 66, C. C. Leighton's Addition to the Townsite of Port Angeles; AND that portion of Fourth Street abutting the northerly line of Lots 7, 8 and 9, Block 171, Townsite of Port Angeles, Clallam County, Washington. Section 2. Compensation. Pursuant to RCW 35.79.030, the compensation required for the vacation of this portion of Fourth Street is $1,848.00. Section 3. Easement Reserved. Pursuant to RCW 35.79.030, the City of Port Angeles hereby reserves an easement over the north 20 feet of the southerly 32 feet of the vacated right -of -way, for public access to the Fourth Street right -of- way, for fire protection, and for the construction, repair and maintenance of utilities, including utilities belonging to the Pacific Northwest Bell Telephone Company. Section 4. Special Terms and Conditions. A. The owners of the property abutting the vacated portion of Fourth Street shall transfer to the City of Port Angeles an easement for use by the public as a public trail at least ten (10) feet in width, the center line of which follows the following described line: Beginning at a point in the Northerly line of Lots 10 through 18, inclusive, in Block 66 of C. C. Leighton's Subdivision of the Townsite of Port Angeles, as recorded in Volume 1 of Plats, page 94, records of Clallam County, Washington, lying South 56 °37'34" East, a distance of 150.46 feet from the Northwesterly corner of said Lot 10; thence South 29 °03'59" West, a distance of 3.75 feet; thence South 0 °59'40" West, a distance of 39.51 feet; thence South 2 °57'51" East, a distance of 11.87 feet; thence South 12 °56'30" East, a distance of 20.03 feet; thence South 18 °39'59" East, a distance of 20.03 feet; thence South 15 °48'14 "East, a distance of 7.86 feet; thence South 29 °05'51" East, a distance of 40.79 feet; thence South 52 °13'09" East, a distance of 39.08 feet; thence North 62 °04'03" East, a distance of 27.38 feet; thence South 47 °34'02" East, a distance of 18.03 feet; thence South 8 °41'14" East, a distance of 18.03 feet; thence South 28 °07'38" East, a distance of 12.98 feet; thence South 49 °55'43" East, a distance of 10.77 feet; thence South 39 °26'25" East, a distance of 8.41 feet; thence South 62 °32'00" East, a distance of 36.82 feet; thence South 3 °24'51" East, a distance of 8.94 feet; thence South 44 °54'38" East, a distance of 15.52 feet; thence South 51 °46'50" East, a distance of 10.77 feet; thence South 14 °02'40" East, a distance of 14.57 feet; thence South 56 °37'53" East, a distance of 7.93 feet to the Easterly line of said Lot 18 and the Easterly terminus of said line. B. The owners of the property abutting the vacated street shall construct a trail over the easement conveyed to the City pursuant to Subsection "A" of this Section at the time of construction of any building or structure on any of the property abutting said vacated Fourth Street, to the satis- faction of the Parks and Recreation Department and the Public Works Department of the City of Port Angeles. Section 5. Quit Claim Deed. Upon compliance with the terms and conditions of this Ordinance, except Section 4(B), the owner of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the -2- J City of Port Angeles for execution by the Mayor, who is hereby I� authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifications upon the title established by this Ordinance. Section 6. Effective Date. This Ordinance shall be effective upon the satisfaction of the terms and conditions of this Ordinance, except Section 4(B), and the Clerk is hereby directed to file, record and publish this Ordinance upon that satisfaction.
