HomeMy WebLinkAbout2206ORDINANCE NO. 01 .264 AN ORDINANCE of the City of Port Angeles revising the energy credit program for low- income senior citizens of Port Angeles, altering the conditions for qualification, and the amounts eligible for payment under that ordinance, and amending Sections 4, 5, 6 and 7 or Ordinance 2107, and Sections 13.20.040, .050, .060 and .070 of the Port Angeles Municipal Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES, as follows: Section 1. Section 4 of Ordinance 2107 and Section 13.20.040 of the Port Angeles Municipal Code are each amended to read as follows: 13.20.040 Information to be made available. The City Clerk shall maintain, at all times the following infor- mation which shall be current and applicable to current applications for, and awards of, energy credits under the terms of this chapter: A. The Washington State median income, adjusted for family size, which shall be used to calculate energy credits to be granted in any particular year; B. A list of all federal, state or local energy - related programs which are available to provide fiscal assistance to low - income senior citizens C. A list of all conservation or consumption reduction programs of the City of Port Angeles, and the requirements for each such program. D. Current application forms. Section 2. Section 5 of Ordinance 2107 and Section 13.20.050 of the Port Angeles Municipal Code are each amended to read as follows: 13.20.050 Qualifications for energy credit. Each recipient of an energy credit must meet the following criteria: A. Be a low- income senior citizen; B. 1. Agree to participate in available conserva- tion or consumption reduction programs of the City of Port Angeles; 2. Failure of the applicant to participate in an available conservation or consumption reduction program, after receipt of an energy credit, shall constitute a basis for denial by the City of partici- pation in the energy credit program during the ensuing years. Section 3. Section 6 of Ordinance 2107 and Section 13.20.060 of the Port Angeles Muncipal Code are each amended to read as follows: 13.20.060 Application for credit. A. Applications for annual energy credits shall be filed with the City Clerk not later than the twenty - fifth day of January of the year for which the credit is desired. Applications shall be for one year only and must be renewed on an annual basis. B. The City may accept applications for energy credits after the 25th day of January for the remaining portion of a calendar year. Acceptance of such'appli- cations shall be dependent upon the existence of unallocated funds within the appropriation for the energy credit program for the current year's budget, after the allocation of funds necessary to provide the annual energy credit to all persons applying before January 25th. Such applications shall be considered in the priority of their filing with the City Clerk. C. Application, qualification, and payment of any energy credit for a portion of the year shall be in accordance with the terms of this ordinance. D. The City Clerk of the City of Port Angeles shall publish a notice in a newspaper of general circulation within the City of Port Angeles, not later than the 10th day of January, of any year. Such notice shall state that an annual energy credit for a low- income senior citizen program is available. E. Submission of an application for an energy credit shall constitute a verification by the applicant that all information provided in such application is true and correct to the best of the applicant's knowledge. Section 4. Section 7 of Ordinance 2107 and Section 13.20.070 of the Port Angeles Municipal Code are each amended to read as follows: 13.20.070 Calculation of credit. Calculation of the amount of the energy credit for eligible low- income senior citizens shall be in accordance with the following procedure: A. The amount available shall depend upon the gross household income of the applicant, based upon the following categories: (i) Group 1 shall consist of applicants whose gross household income does not exceed 38% of the state median income adjusted for family size. (ii) Group 2 shall consist of applicants whose gross household income is greater than 38% but does not exceed 57% of the state median income adjusted for family size. (iii) Group 3 shall consist of applicants whose gross household income is greater than 57% but does not exceed 80% of the state median income adjusted for family size. • • B. Within each group, the amount credited to each eligible low- income senior citizen will be based upon the applicant's gross household income; provided, that no energy credit shall exceed $169 for persons in Group 1,$108.16 for persons in Group 2, or $43.94 for persons in Group 3. Section 5. This ordinance shall take effect in accordance with the provisions of law. Compensation for the street vacation has been received and the applicant has provided assurance that the terms of the vacation will be met. (If the Council is satisfied, a motion adopting the ordinance is sufficient.)
