HomeMy WebLinkAbout2250ORDINANCE NO. om? fTD AN ORDINANCE of the City of Port Angeles defining handicap parking zones, regulating the use thereof, providing for City permits for the use of handicap parking zones, providing penalties for the violation of the Ordinance, and amending Sections 7 and 9 of Ordinance 2016, Section 1 of Ordinance 2105, and adding new sections to Ordinance 2016. Section 1. Section 9 of Ordinance 2016 and Section 1 of Ordinance 2105 are each amended to read as follows: Restricted parking zones designated pursuant to Section 7 of this ordinance, and the allowed use of each restricted zone are as follows: (A). No Parking Zone - no vehicle, except an authorized emergency vehicle, shall park, stand, or stop in a no parking zone. (B). Loading Zone - no vehicle shall park, stop, or stand in a loading zone, except for the purpose of, and only for such period of time as necessary for, expeditious loading or unloading of a commercial or passenger vehicle. In no case shall the stop for loading or unloading of articles or materials or passengers exceed 15 minutes in time. (C). Taxi Zone - no vehicle, other than a for -hire vehicle properly licensed by the City of Port Angeles shall stop, stand, or park in a taxi zone. (D). Police Zone - no vehicle, other than one upon official police business shall stop, stand, or park in a police zone. (E). Bus Stop - no vehicle shall park, stop or stand in a bus stop, except a bus, either to lay over in an operating schedule, or while waiting for, loading, or unloading passengers; provided that such bus provides regularly scheduled service within the jurisdiction of the local authority. (F). Handicap Parking Zone - no vehicle shall park, stand, or stop in a handicap parking zone, unless it displays a legally issued handicap decal, handicap license plate, or handicap permit. Section 2. Section 7 of Ordinance 2016 is hereby amended to read as follows: (A). The chief of police and the director of public works, or the city manager if they cannot agree, are hereby authorized and required to establish limited time, restricted, and parking meter zones on City streets and parking lots. Such zones shall be defined and marked in accordance with the requirements of RCW 46.36.060. (B). Handicap parking zones shall be located and designated as required by Chapter 70.92 RCW. Section 3. There is hereby added to Ordinance No. 2016 a new section as follows: Section 11.1 - Violations - Penalty - Handicap Parking Zone. (A). It is a traffic infraction for any person to park a vehicle in a handicap parking zone, without a special license plate, card, or decal, as provided for in RCW 46.16.380 or without displaying a proper permit as provided for in Section 11.3 of this Ordinance. A person charged with a violation hereof shall not be determined to have committed an infraction if he produces in court or prior to the court appearance the special license plate, special card, special decal or permit required hereunder or demonstrates he was entitled to the same at the time of being ticketed. (B). Any unauthorized use of the special card, special decal, special license plate, or permit provided for in RCW 46.16.380 or Section 11.3 of this Ordinance is a traffic infraction. (C). The penalty for any infraction under this section shall be $25, not including statutory assessments. Section 4. There is hereby added a new section to Ordinance 2016 as follows: Section 11.3 = Local Handicapped Permits. 1. Any person who submits satisfactory proof to the Port Angeles Police Department that he or she has lost both of his or her lower extremities, or has lost the normal or full use thereof, or is so severely disabled as to be unable to move without the aid of crutches or a wheel chair, or has lost both hands, or who suffers from lung disease to such an extent that forced expiratory respiratory volume, when measured by spirometry, is less than one liter per second, shall be entitled to receive a special permit issued by the Port Angeles Police Department, which shall be left in the vehicle in a conspicuous place, bearing distinguishing marks, letters, or numerals, indicating that the vehicle is being used to transport such disabled person. 2. Each application for a local permit shall be accompanied by a fee of $5. 3. Such permit shall allow the vehicle in which it is displayed to be parked in any handicapped parking zone in the City of Port Angeles, so long as the vehicle is engaged in the transportation of the person designated on the permit. • • 4. Such permit shall be valid only within the City limits of the City of Port Angeles, and shall so state upon the face thereof. 5. Such permit shall be valid for the time period stated on the face of the permit, which shall be based upon an estimate of the duration of the disability as stated in the report of the physician.
