A-6150 AN ORDINANCE of the City of Port Angeles establishing a Community Development Fund, Webster Fine Arts Center Trust Fund, and Rhodes Road Improvement Fund . for administration of Federal and municipal funds. WHEREAS, the City Council of the City of Port Angeles will receive funds through the Community Development Block Grant Program; and WHEREAS, the City Council will receive money to be held in trust through the Esther Webster Estate; and WHEREAS, the City Council has received money from private sources to be used for improvements to Rhodes Road; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. There is hereby established in the City Treasury a fund for the fiscal administration of moneys received under the Community Development Block Program. Said fund shall be entitled "Community Development Fund ". Section 2. There is hereby established in the City Treasury a fund for the fiscal administration and accounting for moneys held in trust to the Esther Webster Estate. Said fund shall be entitled "Webster Fine Arts Center Trust Fund ". Section 3. There is hereby established in the City Treasury a fund for the fiscal administration and accounting for moneys held for improvements to Rhodes Road. Said fund shall be entitled "Rhodes Road Improvement Fund ". Section 4. The Director of Finance and Administrative Services is charged with the administration of the three funds created in Sections 1, 2, and 3 above. Section 5. BACKGROUND /ANALYSIS: As you are aware, the City is the recipient of a Community Development Block Grant to aid in the construction of the Lincoln Street Landing project. The City will use the money to provide construction financing for the project, which will be repaid by the developers, and then can be recirculated in the community for community development programs. In order to maintain the best accountability for the amounts loaned to developers and for funds expended for the administration of the program, it is desirable for the City to establish a separate fund. Under State law, such funds must be created by ordinance. The City has also been named beneficiary in the Esther Webster Estate and is required to hold funds in trust and use earnings thereon to pay for the operation of a fine arts center. In order to maintain adequate control, the City is required to establish a separate trust fund for the proceeds of the Estate. Councilman Quast has recently solicited contributions for a "mini -LID" for improvements of Rhodes Road. Until such time that a project is undertaken, the City must hold this money in trust. The contributions total $1,435 and for proper accounting purposes should be held in a separate trust fund similar to the Campbell Avenue Improvement Fund. The attached Ordinance takes care of the appropriate bookwork to create the Funds mentioned above. RECOMMENDATION: We recommend the attached Ordinance be adopted, establishing three new funds for the City. RDW:LF Attachment
