HomeMy WebLinkAbout2395Summary of Ordinance Adopted by the Port Angeles City Council on May 20. 1986 Ordinance No. 2395 This Ordinance of the City of Port Angeles vacates the one -block length of Tumwater Street lying north of Marine Drive; the one -half block length of Cedar Street lying north of Marine Drive; the one - quarter block length of Pine Street lying north of Marine Drive; and the alley lying between First and Second Streets, from the railroad on the west to Marine Drive on the east, all in Clallam County, Washington. Summary of Ordinance Adopted by the Port Angeles City Council on July 3. 1990 Ordinance No. 2600 This Ordinance of the City of Port Angeles amends Section 4 of Ordinance No. 2395, relating to the conditions attached to the vacation set forth in Ordinance No. 2395, which provides that the Port of Port Angeles will reconstruct the intersection of the Truck Route and Marine Drive at such time as the Port constructs the new access roadway into the Port Marine Terminal facility at the Tumwater Truck Route /Marine Drive extension. The full text of the Ordinances are available at City Hall in the City Clerk's office or will be mailed upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. These Ordinances took effect upon the satisfaction of the terms and conditions of the Ordinances. Becky J. A 3 q07 AN ORDINANCE of the City of Port Angeles vacating the one -block length of Tumwater Street lying north of Marine Drive; the one -half block length- of Cedar Street lying north of Marine Drive; the one - quarter block length of Pine Street lying north of Marine Drive; and the alley lying between First and Second Streets, from the railroad on the west to Marine Drive on the east. WHEREAS, a petition is on file with the City of Port Angeles to vacate the one -block length of Tumwater Street lying north of Marine Drive; the one -half block length of Cedar Street lying north of Marine Drive; the one - quarter block length of Pine Street lying north of Marine Drive; and the alley lying between First and Second Streets, from the railroad on the west to Marine Drive on the east; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, have been met and a public hear- ing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Vacation. Subject to the terms and condi- tions of this Ordinance, the following described streets and alley are hereby vacated: The one -block length of Tumwater Street lying north of Marine Drive; the one -half block length of Cedar Street lying north of Marine Drive; the one - quarter block length of Pine Street lying north of Marine Drive; and the alley lying between First and Second Streets, from the railroad on the west to Marine Drive on the east, all in Clallam County, Washington. Section 2. Compensation. Pursuant to RCW 35.79.030, the compensation required for the vacation of these streets and alley is $63,812, to be paid in three (3) installments of $21.271 • 1 as of June 1, 1986, $21,271 as of December 1, 1986, and $21,270 as of June 1, 1987. Section 3. Easement Reserved. Pursuant to RCW 35.79.030, the City of Port Angeles hereby retains an easement over the vacated streets and alley for the construction, repair and maintenance of public utilities. Section 4. Special Terms and Conditions. A. The Waterfront Trail shall be relocated to the north side of the sidewalk on the north side of Marine Drive. The design of the relocated sidewalk shall provide convenient and safe use to the public and shall be acceptable to the City. Any necessary easements shall be provided. B. A general purpose public access and maintenance ease- ment of 10 feet as measured from the banks of Tumwater Creek shall be provided on both sides of Tumwater Creek from Marine Drive to Port Angeles Harbor. C. Access to all municipal fire apparatus, equipment and facilities shall be maintained in a manner acceptable to the City. D. Title to the rights -of -way shall be provided upon the reconstruction and improvement of the intersection of the Truck Route and Marine Drive (Public Works Department Project #85 -33, Tumwater Truck Route /Marine Drive Extension). Section 5. Quit Claim Deed. Upon compliance with the terms and conditions of this Ordinance, the owner of abutting property entitled to the vacated streets and alley, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quick claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifica- tions upon the title established by this Ordinance. Section 6. Effective Date. This Ordinance shall be effective only upon the satisfaction of the terms and conditions -2- • of this Ordinance, and the Clerk is hereby directed to file, record and public this Ordinance upon that satisfaction.
