WHEREAS, a petition is on file with the City of Port Angeles to vacate that portion of First Street abutting Lots 11 to 15, inclusive, Block 133, Thomas W. Carter's Subdivision of Suburban Lots 11 and 16, Townsite of Port Angeles; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, have been met and a public hear- ing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1 - Vacation. Subject to the terms and condi- tions of this Ordinance, the following described portion of a street is hereby vacated: That part of Lots 11 to 15 inclusive, Block 133, Thomas W. Carter's Subdivision of Suburban Lots 11 and 16, Townsite of Port Angeles, Clallam County, according to the plat thereof recorded in Volume 1 of Plats, Page 19, described as beginning at a point opposite Highway Engineer's Station (hereinafter referred to as HES) 6 +50 on the Line Survey of SR 101, Alder Street in Port Angeles to Brooks Street, and 80 feet Northeasterly therefrom; thence Northeasterly to a point opposite said HES and 180 feet Northeasterly therefrom; thence Southeasterly parallel with said Line Survey to a point opposite HES 8 +00 thereon; thence Southeasterly to a point opposite HES 8 +56 on said Line Survey and 80 feet Northeastly therfrom; thence Northwesterly to the point of beginning. The specific details concerning all of which may be found on Sheet 2 of that certain plan entitled SR 101, Alder St. in Port Angeles to Brooks St., now of record and on file in the office of the Secretary of Transportation at Olympia, Washington, bearing date of approval of August 25, 1964. Section 2 - Compensation. Pursuant to RCW 35.79.030, the compensation required for the vacation of this street is -1- Section 3 - Quit Claim Deed. Upon compliance with the terms and conditions of this Ordinance, the owner of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifica- tions upon the title established by this Ordinance. Section 4 - Effective Date. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the Clerk is hereby directed to file, record and publish this Ordinance upon that satisfaction.
