HomeMy WebLinkAbout2503ORDINANCE N0. 2503 AN ORDINANCE of the City of Port Angeles relating to extensions on Conditional Use Permits and amending Article IX, Section 7, of the Zoning Code, Ordinance No. 1709. WHEREAS, the City Council has found it to be in th public interest to improve the permitting process; and WHEREAS, the City Council finds it desirable to delegat the processing of certain routine Zoning permits under certai specified procedures and criteria; and WHEREAS, the City Council finds it of benefit to th general public to have timely processing of Zoning permits; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAI as follows: Section 1. Article XI, Section 7, of the Zoning Code Ordinance No. 1709, is hereby amended to read as follows: SECTION 7 - HEARING AND APPEAL OF CONDITIONAL USE APPLICATIONS Notice and Hearing for Conditional Use Permits Upon filing an application for a Conditional Use Permit i which the application sets forth fully the grounds for, an the facts deemed to justify, the granting of the Conditiona Use Permit, the Planning Commission shall give public notice as provided in the Laws of the State of Washington an articles in these Regulations which are applicable hereto, o the intention to consider at a public hearing the granting o the Conditional Use Permit. The Planning Commission shall after said hearing, refer its recommendation to the Cit Council for final action. Notice of Action on Application When the action of the Council is to approve or deny a application, the Building Inspeeter Official, within fourtee (14) days from the date of such action, shall notify th applicant by forwarding a copy of the action. Decision of the Council Shall be Final Action of the City Council on applications in regard t Conditional Use Permits shall be held at public hearings an shall be final and conclusive. Requests for Exceptions All applications for exceptions from this Zoning Regulation shall contain all basic information, along with othe pertinent facts, maps and data required by the Plannin Commission. -1- Permits Void After One Year All Conditional Use Permits shall become void one year fron the date of granting such permits if use of the land or buildings has not taken place in accordance with the provisions in granting said requests. Extensions of Approved Conditional Uses The Planning Director or his designee is authorized to grant extensions for those approved conditional uses that have specified time periods of authorization, provided the following procedures and criteria are met: A. Procedures. 1. The request for extension must be submitted prim{ to expiration of the permit. 2. The rectuest shall be posted in the same manner as for a new Conditional Use Permit. 3. The Planning Director shall hold a public hearing. B. Review Criteria. Following the public hearing, the Planning Director ma issue extensions for one to five years, providing th& following criteria have been met: 1. The use complies with the permit conditions. 2. There have been no changes in circumstances. 3_ There have been no complaints from surrounding property owners or local agencies. If there hav been complaints, the extension shall be reviewed by the Planning Commission, rather than the Planning Department. C. Appeals. 1. Any person aggrieved by the decision of the Planning Director may appeal the decision. 2. Appeals shall be submitted to the Planning Department in writing within fifteen (15) day following the date of mailing the decision to the applicant and any person(s) submitting written comments or testifying at the public hearing. 3. The Planning Commission shall hear the appeal at its next possible public meeting and thereupon make a recommendation to the City Council to uphold, reverse, or modify the decision, based upon the compliance of the permit with the requirements of the Zoning Code. Such recommendation shall include written findings of fact. 4. The City Council at its next possible public meeting, following receipt of the Planning Commission recommendation, may adopt, reverse, or modify the Planning Commission' recommendations and shall set forth written findings of fact. -2- 5. An further a••eal shall be to the Clallam Count Superior Court. Section 2. This Ordinance shall take effect five (5 days following date of publication.
