HomeMy WebLinkAbout2559ORDINANCE NO. 2559 AN ORDINANCE of the City of Port Angeles, Washington, approving and confirming the assessments and the assessment roll in Local Improvement District No. 209 for the construction of certain improve- ments within the City and levying and assessing the amounts thereof against certain property as shown on said assessment roll. WHEREAS, notice of the time and place of hearing on the ssessment roll for Local Improvement District No. 209 was duly nd regularly given to all property owners within said district •y publication thereof and by mailing to all property owners hose names appeared on said assessment roll, in the manner •rovided by law; and WHEREAS, at the time and place fixed for said hearing, the Council met and duly considered said assessment roll and the various protests filed against said roll, and after consideration thereof, determined to order the roll confirmed as presented; and WHEREAS, the fairest and most equitable method of allocating costs according to special benefits for this LID is the per lot rather than the zone and termini method of assessment; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PORT ANGELES, WASHINGTON, as follows: Section 1. The assessments and assessment roll of Local Improvement District No. 209 for the construction and installation of the improvements described in Ordinance No. 2507 of the City, as presented to the Council at the hearing thereof, in the total amount of $79,076.85, are hereby approved and confirmed, as set forth in the attached Exhibits "A ", "B ", and "C" Section 2. Each of the lots, tracts, parcels of land, nd other property shown upon said roll is hereby declared to be -1- pecially benefitted by said improvements in at least the amount harged against the same, in accordance with the per lot method f assessment. There is hereby levied and assessed against such ot, tract, parcel of land, and other property appearing upon aid roll the amount finally charged against the same thereon. Said amount or any portion thereof may be paid at ny time within thirty (30) days from the date of the first ublication of the city Treasurer's notice that the assessment oll has been placed in his hands for collection, without enalty, interest, or costs, and thereafter the sum remaining npaid, if any, may be paid in ten (10) equal annual installments ith interest on the whole unpaid sum at the rate not to exceed 8.5 percent per annum. Commencing with the first year after the date thirty (30) days after the first publication of said notice, and each year thereafter, one of said installments, together with the interest due thereon, shall be collected as provided by law and the ordinances of the City of Port Angeles, Washington. Section 3. This Ordinance shall take effect five (5) days after date of publication. WASHINGTON 98362 PHONE (206) 457 -0411 TO: City Manager, Mayor and i Council FROM: Public Works Department SUBJECT: Sixth Street Paving, L.I.D. . 212 ISSUE: Should the final assessment roll for L.I.D. No. 212 be accepted? BACKGROUND /ANALYSIS: The City Council authorized construction of the Sixth Street Paving No. 212 on September 6, 1988, by Ordinance No. 2506. A contract for construction was awarded to Lakeside Industries and the project was completed by the contractor and accepted by the City Council on December 5, 1989. All costs are known and a final assessment roll has been prepared along with a listing of expenses, justification for CIty contribution to areas determined to be of public benefit, and the final assessment roll (copies attached). RECOMMENDATION: It is the recommendation of the Public Works Department that the City Council accept the list of expenses and justification for City contribution and the final assessment roll be confirmed. City Engineer Attachments bu Justification Sixth Street Paving Local Improvement District No. 212 The City of Port Angeles has received public benefit by the improvement of the Sixth Street Paving by the L.I.D. method in the following manner: In an effort to reduce the project costs, the City of Port Angeles constructed the Sixth Street L.I.D. in conjunction with two other L.I.D.'s. During the course of the construction, it was found that one of the L.I.D.'s (Regent Street) had some additional costs associated with bringing the roadway up to standards. Due to the increased costs to the Regent Street L.I.D., the City contributed the engineering costs to the Regent Street project. Since all of the L.I.D.'s were constructed as one project and in an effort to be fair and equitable, the Public Works Department recommends that the City contribute the engineer- ing costs to the Sixth Street L.I.D. The City will benefit by reduced maintenance costs in roadway patching and equipment costs in roadway patching and elimination of hazards associated with numerous potholes on this section of roadway. While it is true that the residents of the area received a significant benefit, it should also be noted that the City will also receive a benefit. Besides reducing a maintenance cost on this section of roadway, maintenance costs to City vehicles, such as Solid Waste trucks and /or City service vehicles, should be reduced (as well as private citizen's vehicles) because of the improved driving surface and absence of potholes. 1/10/90
