HomeMy WebLinkAbout2568ORDINANCE NO. 2568 AN ORDINANCE of the City of Port Angeles, Washington, amending the Off - Street Parking Ordinance (Ordinance No. 1588, as amended) and Chapter 14.40 of the Port Angeles Municipal Code, and repealing Sections 2 through 12 of Ordinance No. 2097 and Chapter 11.20 of the Port Angeles Municipal Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT NGELES as follows: Section 1. Section 1 of Ordinance 2228 and Section 14.40.010 of the Port Angeles Municipal Code are each amended as follows: 14.40.010 Definitions. A. The following terms shall have the designated meanings for the purposes of this Chapter, unless the context indicates otherwise: 1. "Standard -car parking space" means one hundred sixty -six and one -half square feet of parking lot area, nine feet by eighteen feet six inches minimum in size, having adequate access to a public street. No part of any street right -of -way shall be considered part of any standard -car parking space. 2. "Compact -car parking space" means one hundred twenty square feet of parking lot area, eight feet by fifteen feet minimum in size, having adequate access to a public street. No part of any street right -of -way shall be considered part of any compact -car parking space. 3. "Loading space" means a space located adjacent to a building, and large enough in area so that any truck or other ehicle loading or unloading at such building will not project into a street right -of -way. -1- 4. "Floor area" means the leasable or habitable floor area or space in a dwelling or building, excluding bathrooms, toilet compartments, halls, closets, or corridors 44 inches in width or less, maintenance and cleaning supply rooms of 50 square feet or less, and equipment and machinery rooms not used directly in the manufacture, production, storage or sale of goods or services. 5. "Parking lot activity" means a non - permanent activity occurring in a parking lot, usinq spaces otherwise allocated for parking for purposes other than parking by clientele of the primary use of the property. B. All other terms used in this Chapter shall have the meaning given to them by Ordinance 1709, as now enacted, or hereafter amended, unless the context indicates otherwise. Section 2. The following section shall be added to Chapter 14.40 of the Port Angeles Municipal Code: 14.40.185 Parking Lot Activity Standards. All parking lot activities shall comply with the following standards: A. No such activity shall occur in parking spaces directly in front of entrances or windows of a building. B. Such activities shall not occupy more than 10% of the total number of spaces in the parking lot. C. Such activities shall not block entrances and exits to the parking lot or fire exit doors of any buildings. D. Such activities shall not occur in parking lots containing fewer than 20 spaces. E. All such activities shall comply with all other applicable City Ordinances and State Statutes. F. Each activity shall only be for a period not to exceed thirty (30) days for private businesses and sixty (60) days for private non - profit and charitable organizations within a one -2- calendar year period. the public G. The location and activity shall not endanger health, morals, safety and welfare. 2228 and PAMC Section 3. Section 20 of Ordinance 14.40.200 are hereby amended to read as follows: 14.40.200 Violation - D-ei..ed HiOdChIVa „1,L. Any corporation, in charge of premises which violate any of the provisions of this Chapter, shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Chapter is committed continued, or permitted. By adding a definition of "Parking Lot Activity" to mean a non- permanent activity occurring in a parking lot, using spaces other- wise allocated for parking purposes other than parking by clientele of the primary use of the property, and setting standards for said activity. By deleting the requirement of a parking lot activity permit, and by changing the penalty for violation of the Off - Street Parking Ordinance from a misdemeanor to a $500 civil fine.
