HomeMy WebLinkAbout2582ORDINANCE NO. 2582 AN ORDINANCE of the City of Port Angeles, Washington, amending Section 14.21.060 of Ordinance No. 2552 and adding Section 14.21.070 to Ordinance No. 2552 relating to adoption, administration and enforcement of the 1988 edition of the Uniform Fire Code, establishing a fee for permit issuance, and establishing a penalty for violation of Code provisions. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Section 14.21.060 of Ordinance No. 2552 is hereby amended to read as follows: 14.21.060 .- - pen Burning Limitations - Burning Permits Required. Natural vegetation, such as brush, leaves, and tree trimmings, may be burned on private property upon opccial permit from the Port Angcica Firc Department. No beverage, dead animals, or material containing asphalt, petroleum products, paint, rubber products, plastics, er any substance which normally cmits dense smoke or obnoxious odors will be allowed to be burned. A. No garbage, dead animals, or materials containing asphalt, petroleum products, paint, rubber products, plastics or any substance which emits dense smoke or obnoxious odors will be allowed to be burned. B. Natural vegetation such as brush, leaves and tree trimmings, may be burned upon private property in accordance with the regulations of the Port Angeles Fire Department upon obtaining a permit from the Fire Department as provided in Sections C and D. C. A one -day permit for open burning of natural vegetation for a fire that will be no larger than four feet in diameter shall be issued without charge by the Port Angeles Fire Department verbally, by contacting the Fire Department at 457 -0411, extension 255, and leaving the applicant's name and address. D. A written permit good for a five -day period is required for open burning of natural vegetation for a fire that will be larger than four feet in diameter and shall be issued only -1- upon completion of an on -site inspection, scheduled 24 hours in advance. by Fire Department personnel. The fee for said permit is $25.00. The permit period may be extended for a reasonable period for good cause. The written copy of the open burning permit and regulations shall be maintained on site at all times during burning operations. Section 2. Section 14.21.070 is hereby added to Ordinance No. 2552, to read as follows: 14.21.070 Violations and Penalties. Any person, firm, or corporation, violating any of the provisions of Chapter 14.21 or of the rules and regulations adopted by the Port Angeles Fire Department as conditions for the issuance of a burning permit shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter or of the rules and regulations adopted as condi- tions for the issuance of a permit is committed, continued or permitted. Each such violation shall be punishable in the same manner as violations of the construction codes of the City of Port Angeles as set forth in PAMC 14.01.100. Section 3 - Severability. If any provisions of this Ordinance, or its application to any person or circumstance, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 4 - Effective Date. This Ordinance shall take effect five days after the date of publication.
