HomeMy WebLinkAbout2587ORDINANCE NO. 2587 AN ORDINANCE of the City of Port Angeles, Washington, creating an exception to the secondary sewer assessment charge. WHEREAS, the City Council deems it inappropriate and unfair that the secondary sewer assessment be charged for water service connections for those new residences that may have been pre -sold but not yet constructed prior to notice and implementation of the secondary sewer assessment charge; and WHEREAS, allowing an exception in such circumstances will affect a limited number of new residences for a short period of time and will not have a significant adverse effect on sewer utility revenues; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. The secondary sewer assessment established by Ordinance 2572 shall not be charged for water service connections for new residences that have been pre -sold but for which the necessary construction permits had not been obtained prior to the effective date of Ordinance 2572, and any such charges that have been collected by the City shall be refunded; PROVIDED, HOWEVER, that sufficient proof of such pre -sale shall have been provided by the contractor to the Public Works Department. Section 2 - Effective Date. This Ordinance shall take effect five days after date of publication. PASSED by the City Council of the City of Port Angeles at a regular meeting of said Council held on the 1st day of May, 1990.
