HomeMy WebLinkAbout2589ORDINANCE NO. 2589 AN ORDINANCE of the City of Port Angeles vacating that portion of East Sixth Street abutting Lots 10 and 11, Block 189, abutting Lots 17 and 18, Block 190, abutting Lot 1 and the east 30 feet of Lot 2, Block 211, abutting Lot 9, Block 212, TPA, and abutting Lot 4, Block C, Cresthaven Subdivision, TPA. WHEREAS, a petition and a request are on file with the City of Port Angeles to vacate that portion of East Sixth Street abutting Lots 10 and 11, Block 189, abutting Lots 17 and 18, Block 190, abutting Lot 1 and the east 30 feet of Lot 2, Block 211, abutting Lot 9, Block 212, and abutting Lot 4, Block C, Cresthaven Subdivision, Townsite of Port Angeles; and WHEREAS, the City Council initiated said vacation by Resolution No. 6 -90; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, have been met and a public hear- ing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1 Vacation. Subject to the terms and condi- tions of this Ordinance, the following described street is hereby vacated: That portion of East Sixth Street abutting Lots 10 and 11, Block 189, abutting Lots 17 and 18, Block 190, abutting Lot 1 and the east 30 feet of Lot 2, Block 211, abutting Lot 9, Block 212, and abutting Lot 4, Block C, Cresthaven Subdivision, Townsite of Port Angeles, Clallam County, Washington. -1- Section 2 Compensation. Pursuant to RCW 435.79.030, the compensation required for the vacation of this street is $ 11,910.25 Section 3 Easement Provided. An easement to access utility facilities will be provided approximately as shown in the attached Exhibit "A" and a twenty -foot non - exclusive easement for ingress and egress shall be formally granted to the City and to the owners of property adjacent to the right -of -way vacated herein, by written easements in a form acceptable to the City from the owners of the property adjacent to said street. Section 4 Conditions. All properties under a single ownership shall be combined through the zoning lot covenant process. Section 5 Quit Claim Deed. Upon compliance with the terms and conditions of this Ordinance, the owners of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifications upon the title established by this Ordinance. Section 6 Effective Date. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the Clerk is hereby directed to file, record, and publish this Ordinance upon that satisfaction. -2- PASSED by the City Council of the City of Port Angeles at a regular meeting of said Council held on the 15th day of May, 1990.
