HomeMy WebLinkAbout2593ORDINANCE NO. 2593 AN ORDINANCE of the City of Port Angeles, Washington, revising the requirements for disposal of surplus real and personal property and amending Ordinances No. 2168 and 2254 and Chapter 2.60 of the Port Angeles Municipal Code. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Section 1 of Ordinance No. 2168, Section 1 of Ordinance No. 2254, and PAMC 2.60.010 are hereby amended to read as follows: 2.60.010 Determination of Property to be Declared Surplus. Prior to selling or otherwise disposing of any City property, the City Council shall determine whether the property to be sold or otherwise transferred is necessary to the further and efficient operation of the City. In making such determination, the City Council shall comply, if applicable, with the provisions of RCW 39.33.020, as now enacted or hereafter amended, by holding a public hearing. At least ten days but not more than twenty -five days prior to such hearing, the City Clerk shall publish a public notice of reasonable size in display advertising form, setting forth the date, time and place of the hearing at least once in a newspaper of general circulation. A news release pertaining to the hearing shall be disseminated among the printed and electronic media. If real property is involved the public notice and news release shall identify the property using a description which can easily be understood by the public and shall describe the proposed use of the lands involved. If the Council determines the property to be no longer necessary, it shall so declare by motion. Disposal of the property shall then be in accordance with the terms of this Chapter. Section 2. Section 2 of Ordinance No. 2168 and PAMC 2.60.020 are hereby amended to read as follows: 2.60.020 Exceptions to Chapter Applicability. This Chapter shall not apply to the following dispositions of - 1 - property: A. When the sale or other disposition is to anothcr govcrnmental agcncy When the estimated value of the property to be disposed of is $5,000 or less; B. When personal property disposed of is to be traded in upon the purchase of a like vehicle, provided that the provisions of Section 2.60.030 shall be complied with; C. When the Council, by resolution, has determined that an emergency exists. Section 3. This Ordinance shall take effect as provided by law.
