HomeMy WebLinkAbout2626ORDINANCE NO. 2626 AN ORDINANCE of the City of Port Angeles vacating that portion of the East First Street right -of -way in Lots 10 -15, Block 133, Thomas W. Carter's Subdivision of the Townsite of Port Angeles, together with that portion of the East First Street right -of -way in the West Half of vacated Virginia Park and Terrace Subdivision, TPA. WHEREAS, a petition and a request are on file with the City of Port Angeles to vacate that portion of the East First Street right -of -way in Lots 10 -15, Block 133, Thomas W. Carter's Subdivision of the Townsite of Port Angeles, together with that portion of the East First Street right -of -way in the West Half of vacated Virginia Park and Terrace Subdivision, Townsite of Port Angeles; and WHEREAS, the City Council initiated said vacation by Resolution No. 1 -91; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, have been met and a public hear- ing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1 Vacation. Subject to the terms and condi- tions of this Ordinance, the following described street is hereby vacated: That portion of the East First Street right - of -way in Lots 10 -15, Block 133, Thomas W. Carter's Subdivision of the Townsite of Port Angeles, together with that portion of the East First Street right -of -way in the West Half of vacated Virginia Park and Terrace Subdivision, Townsite of Port Angeles, Clallam County, Washington, as shown on the map attached hereto and made a part hereof as Exhibit "A ". Section 2 Compensation. Pursuant to RCW 35.79.030 and RCW 47.24.020(15), since the area to be vacated was originally -1- • • acquired by the State of Washington at the State's sole expense, the compensation required for the vacation of this street is the full appraised value of the vacated area, which amount shall be paid directly to the State of Washington. Section 3 Conditions. Owners of adjacent property shall be required to upgrade the area by installing sidewalks and reconstructing driveways to specifications of the Public Works Department. Section 4 Quit Claim Deed. Upon compliance with the terms and conditions of this Ordinance, the owners of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifications upon the title established by this Ordinance. Section 5. Effective Date. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the Clerk is hereby directed to file, record, and publish this Ordinance upon that satisfaction.
