HomeMy WebLinkAbout2678ORDINANCE NO. 2678 AN ORDINANCE of the City of Port Angeles vacating that portion of the 7/8 alley abutting Lots 1 - 5 and Lots 14 - 18, Block 229, TPA. WHEREAS, a petition and a request are on file with the City of Port Angeles to vacate that portion of the 7/8 alley abutting Lots 1 - 5 and Lots 14 -18, Block 229, Townsite of Port Angeles; and WHEREAS, the City Council initiated said vacation by Resolution No. 2 -93; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, have been met and a public hear- ing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1 Vacation. Subject to the terms and condi- tions of this Ordinance, the following described portion of the 7/8 alley is hereby vacated: That portion of the 7/8 alley abutting Lots 1 - 5 and Lots 14 - 18, Block 189, Townsite of Port. Angeles, Clallam County, Washington. Section 2 Compensation. Pursuant to RCW 35.79.030, the compensation required for the vacation of this portion of the 7/8 alley is $ 4.50 /square foot Section 3 Conditions. A. A 10 -foot wide easement on the south side of the vacated alley to cover the existing power lines shall be provided. B. A utility easement within the vacated alley to provide Public Works access to the exiting sewer lines shall be provided. C. A turn - around acceptable to the Fire Department shall be -1- provided. D. A reciprocal access easement which benefits Lots 5 and 14 shall be provided for that portion of the vacated alley abutting said lots. Section 4 Quit Claim Deed. Upon compliance with the terms and conditions of this Ordinance, the owners of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifications upon the title established by this Ordinance. Section 5 Effective Date. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the Clerk is hereby directed to file, record, and publish this Ordinance upon that satisfaction. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. This Ordinance became effective at the time the terms and conditions of the Ordinance were satisfied.
