HomeMy WebLinkAbout2681ORDINANCE NO. 2681 AN ORDINANCE of the City of Port Angeles establishing a code of conduct for the administration of Federal grant funds and creating a new Chapter 2.72 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. A new Chapter 2.72 of the Port Angeles Municipal Code is hereby created to read as follows: CHAPTER 2.72 CODE OF CONDUCT Sections: 2.72.010 Purpose. 2.72.020 Applicability. 2.72.030 Prohibitions. 2.72.040 Penalties. 2.72.010 Purpose. The purpose of this Code of Conduct is to ensure the efficient, fair, and professional administration of Federal grant funds in compliance with Federal Office of Management and Budget (OMB) Circular A -102, Attachment 0, Paragraph 7, and other applicable Federal and State standards, regulations, and laws. 2.72.020 Applicability. This Code of Conduct applies to all officers, employees, and agents of the City of Port Angeles engaged in the award or administration of contracts supported by Federal grant funds. 2.72.030 Prohibitions. No officer, employee, or agent of the City of Port Angeles shall participate in the selection, award, or administration of a contract supported by Federal grant funds if a conflict of interest, real or apparent, would be involved. Such a conflict would arise when any of the following has a financial or other interest in the firm selected for award: A. the employee, officer, or agent; -1- B. any member of his /her immediate family; C. his /her partner; or D. an organization which employs or is about to employ any of the above. No officer, employee, or agent of the City of Port Angeles shall solicit or accept gratuities, favors, or anything of monetary value from contractors, potential contractors, or subcontractors. 2.72.040 Penalties. Any officer, employee or agent of the City of Port Angeles violating any provision of this Chapter shall be liable to the City for a penalty in the amount of three hundred dollars, in addition to any other civil or criminal liabilities or penalty or may otherwise be imposed upon him or her by law. In addition to all other penalties, civil or criminal, the violation by any City employee of any provision of this Chapter shall be grounds for disciplinary action. Section 2. This ordinance shall become effective five (5) days after the date of publication. The code of conduct ensures the efficient, fair, and professional administration of Federal grant funds in compliance with Federal Office of Management and Budget requirements, and other applicable Federal and State standards, regulations, and laws. The full text of the Ordinance is available at City Hall in the City Clerk's office or will be mailed upon request.
