HomeMy WebLinkAbout2723ORDINANCE NO. 2723 AN ORDINANCE of the City of Port Angeles vacating portions of Fifth Street and the 5/6 alley in Block 94, Townsite of Port Angeles. WHEREAS, a petition was filed with the City of Port Angeles to vacate the south half of Fifth Street abutting Lots 1 and 2, and the 5/6 alley abutting Lots 1 and 2 and a portion of Lot 3, and Lots 19 and 20 and a portion of Lot 18, Block 94, Townsite of Port Angeles; and WHEREAS, the City Council set a public hearing for said vacation by passing Resolution No. 34 -92; and WHEREAS, the requirements of Chapter 43.21C RCW, the State Environmental Policy Act, were met and a public hearing was held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1 - Vacation. Subject to the terms and conditions of this Ordinance, the following described street is hereby vacated: The south half of Fifth Street abutting Lots 1 and 2, Block 94, Townsite of Port Angeles, and the 5/6 alley abutting Lots 1 and 2, and a portion of Lot 3, and Lots 19 and 20 and a portion of Lot 18, Block 94, Townsite of Port Angeles, Clallam County, Washington, except those portions of Fifth Street and the 5/6 alley lying in the PBP zoning district boundary at the toe of the ravine. Section 2 - Compensation. Pursuant to RCW 35.79.030, the compensation required for the vacation of these streets is $1,750 for Fifth Street and $1,250 for the 5/6 alley. In lieu of payment, the City will accept a trade for property of equal or greater value, namely Lot 4, Block 94, TPA. -1- Section 3 - Condition. The transfer of ownership of the portion of Fifth Street vacated by this Ordinance shall be held in abeyance either for eighteen months from the adoption of this Ordinance or until the City Council adopts a new comprehensive land use plan, whichever occurs first. If the new comprehensive land use plan includes a provision for a Fifth Street bridge as part of the plan's transportation element and circulation system, then Fifth Street shall not be deemed vacated. Section 4 - Quitclaim Deed. Upon compliance with the terms and conditions of this Ordinance, the owners of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quitclaim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quitclaim deed. Such quitclaim deed shall include all reservations, conditions, or other qualifica- tions upon the title established by this Ordinance. Section 5 - Effective Date. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the Clerk is hereby directed to file, record, and publish this Ordinance upon that satisfaction.
