HomeMy WebLinkAbout2753ORDINANCE NO. 2753 AN ORDINANCE of the City of Port Angeles, Washington, annexing approximately five acres into the City. WHEREAS, pursuant to RCW 35A.14.120, the necessary petition has been filed with the City of Port Angeles requesting annexation to the City of Port Angeles of an approximately five - acre area which is contiguous to the City; and WHEREAS, the necessary legal steps in connection with the petition have been completed, including the holding of a public hearing on the petition after due and legal notice thereof; and WHEREAS, the requirements of the State Environmental Policy Act, Chapter 43.21C RCW have been met; and WHEREAS, the City Council believes that it is in the best interests of the City and its residents that the petition for annexation be granted; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. The following described area, which is shown in the attached Exhibit "A ", is hereby annexed to the City, subject to the conditions set forth in Sections 2, 3, and 4: The southern one -half of Block 5, the northern one -half of Block 8, and the adjacent rights -of -way lying north of the center -line of the statutorily vacated Eckard /Leighton alley extended to the present City limits, Illinois Addition, Township of Port Angeles, Clallam County, State of Washington. Section 2. The annexed area shall bear a pro rata share of the outstanding indebtedness of the City. Section 3. Pursuant to PAMC 17.95.110, the zoning classification of the annexed area shall be RS -9, Residential Single- Family District. Section 4. The owner shall comply with the -1- requirements of the Annexation Agreement (Exhibit "B "). Section 5. This Ordinance shall take effect five (5) days after date of publication. I , Page 128 0.89a. 254 51' ti I0 4 30 4 e ROCKFORD ANNEXATION ANX 92(10)01 Exhibit "B" ANNEXATION AGREEMENT This Annexation Agreement is entered into this //6 day of 1993, by and between the City of Port Angeles, a municipal corporation, hereinafter referred to as the "City ", and Norman Rockford and Janice Andrew, the owners of the annexed area, hereinafter referred to as "Owners ". REPRESENTATIONS 1. Norman Rockford and Janice Andrew are the owners of property contiguous to the City of Port Angeles, which property is described as follows and is hereinafter referred to as the "annexed area ": The southern one -half of Block 5, the northern one -half of Block 8, and the adjacent rights -of -way lying north of the center -line of the statutorily vacated Eckard/ Leighton alley extended to the present City limits, Illinois Addition, Township of Port Angeles, Clallam County, State of Washington. 2. The Owners are desirous of connecting to City water, sewer, and light systems, and the City is willing that the Owners be allowed to do so under certain conditions. 3. The annexed area was originally platted in 1907, and contains lots which are substandard under the City's Zoning Code and contains several rights -of -way which have been vacated. 4. The City is willing to take the annexed area into the City as long as the annexed area is replatted in conformance with current City requirements, including the necessary street rights - of -way and utility easements. AGREEMENTS NOW, THEREFORE, in consideration of the above representations and the mutual covenants herein contained, it is agreed as follows: 1. Prior to any development or issuance of building permits within the annexed area, Owners will replat the annexed area in accordance with the requirements of Chapter 58.17 RCW and all applicable City ordinances, specifications, and policies, which may include but not necessarily be limited to sanitary sewers, water, electric power, paved streets, curbs, gutters, sidewalks, and storm sewers. Owners shall dedicate through the subdivision process or by quit claim deed to City the necessary rights -of -way and easements required by said replat. -1- Exhibit "B" 2. City will allow annexation of the area and provide (at owners' expense) water, light, and sewer connection to presently existing and presently located City utility systems, unless it is determined by the City Engineer that capacity of existing sewer and water lines are inadequate to serve the annexed area, in which case, the Owners will be responsible for upgrading the lines prior to or at the time of obtaining subdivision approval. 3. This annexation agreement shall be binding on Owners, their heirs, assigns, and successors in interest, and shall be recorded with the Clallam County Auditor's Office. Hallett, Mayor ATTEST: DTI Becky J� UOon, Ciity Clerk APPROVED AS TO FORM: Craig D. nutson, City Attorney PLAN.567 NORMAN ROCKFORD ___. _,....../.....,,,,,4 JANICE ANDREW Summaries of Ordinances Adopted by the Port Angeles City Council on March 16. 1993 Ordinance No. 2751 This Ordinance of the City of Port Angeles rezones property legally described as all that property lying between Lauridsen Boulevard and Park Avenue in the Southwest quarter of Section 11, Township 30 North, Range 6 West, W.M., more particularly described as follows: All of Blocks, 2, 3 and 4, including alleys, Nantucket, Greyburn, Elmore, Lafayette Streets and Manhatten Avenue, and all of vacated Blocks 9, 10 and 11, and the East Half of Lots 1 through 11, Block 8, and the abutting vacated streets and alleys, in Campbell's Addition to Port Angeles, as recorded in Volume 2 of Plats, page 2, records of Clallam County, Washington. This Ordinance rezones the above described property from RS -9, Residential Single - Family, to RMD, Residential Medium Density, and amends the Official Zoning Map. Ordinance No. 2752 This Ordinance of the City of Port Angeles amends Ordinance No. 1709, as amended, and Title 17 of the Port Angeles Municipal Code to allow fire stations as a conditional use in the CSD -C1, CSD -C2, ACD, CBD, LI and M -2 Districts. Ordinance No. 2753 This Ordinance of the City of Port Angeles annexes the following described property into the City: The southern one -half of Block 5, the northern one -half of Block 8, and the adjacent rights -of -way lying north of the center -line of the statutorily vacated Eckard /Leighton alley extended to the present City limits, Illinois Addition, Township of Port Angeles, Clallam County, State of Washington. This approximately 5 acre area will bear a pro -rata share of the outstanding indebtedness of the City and will be zone RS -9, Residential Single - Family Ordinance No. 2754 This Ordinance of the City of Port Angeles implements the Public Disclosure Act, Chapter 42.17 RCW, and establishes a new Chapter 2.74 in the Port Angeles Municipal Code, which provides for the administration of the requirements for public disclosure and availability of City records and establishes guidelines and procedures to assure that appropriate records and information are made available to the public for inspection or copying. Ordinance No. 2755 This Ordinance of the City of Port Angeles amends Section 1 of Ordinance 2720 and PAMC 5.80.030(D) by amending the definition of "competitive telephone service" in the City's Public Utility Tax Ordinance. The full texts of the Ordinances are available at City Hall in the City Clerk's office or will be mailed upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. These Ordinances shall take effect five days after the date of publication of these summaries. Becky J.
