HomeMy WebLinkAbout2759ORDINANCE NO. 2759 AN ORDINANCE of the City of Port Angeles vacating a portion of the 13/14 alley west of Pine Street, Port Angeles, Washington. WHEREAS, a petition and a request are on file with the City Clerk requesting the vacation of that portion of the 13/14 alley abutting Lots 9, 10, 11 and 12, in Block 390, Townsite of Port Angeles; and WHEREAS, the City Council initiated said vacation by Resolution No. 11 -93; and WHEREAS, street vacations are categorically exempt under the State Environmental Policy Act Rules WAC 197 -11 -800 (2)(h); and WHEREAS, a public hearing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1 - Vacation. Subject to the terms and conditions of this Ordinance, the following described street is hereby vacated: That portion of the 13/14 alley abutting Lots 9 - 12 in Block 390, Townsite of Port Angeles. Section 2 - Conditions. 1. The applicant shall enter into a zoning lot covenant for the purposes of merging the north one -half of Lots 11 and 12, Block 390, with the vacated alley and the south 10 feet of Lots 9 - 10, Block 390, TPA. 2. The south 10 feet of Lots 7 - 8, Block 390, shall be exchanged for the vacated one -half alley adjacent to Lots 9 - 10, Block 390. Compensation for the remaining one -half alley shall be set by the City Council based on the Real Estate Committee's recommendation. 3. No portion of alley right -of -way east of the top of the ravine shall be vacated. 4. An easement for purposes of maintaining the sewer line located in the vacated alley shall be granted in favor of the City of Port Angeles. 5. The applicant shall demonstrate to the satisfaction of the City Attorney that the addition of the south 10 feet of Lots 7 - 10, Block 390, to the subject property was consistent with the City's subdivision and zoning regulations, or the owners of Lots 7 & 8 and 9 & 10, Block 390, shall file zoning lot covenants merging their respective properties together to form two legal sized lots. Section 3 - Compensation. Compensation required for the vacation of this alley is the south 10 feet of Lots 7 -8, Block 390, TPA and $ $780.00 Section 4 - Quit Claim Deed. The owners of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifications upon the title established by this Ordinance. Section 5. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the City Clerk is hereby directed to file, record, and publish this Ordinance upon that satisfaction.
