HomeMy WebLinkAbout2782ORDINANCE NO. 2782 AN ORDINANCE of the City of Port Angeles vacating a portion of Peabody Street adjacent to Lot B, Grant's Addition to Port Angeles. WHEREAS, a petition and a request are on file with the City of Port Angeles to vacate a portion of the Peabody Street right -of -way; and WHEREAS, the City Council initiated said vacation by Resolution No. 33 -93; and WHEREAS, street vacations are categorically exempt under the State Environmental Policy Act Rules WAC 197 -11 -800 (2) (h) ; and WHEREAS, a public hearing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and; WHEREAS, said vacation appears to be of benefit to and in the interest of the public; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1 - Vacation. Subject to the terms and conditions of this Ordinance, the following described street is hereby vacated: All that portion of Peabody Street, as platted but not as developed, abutting Lot B of Short Plat 77- 12 -12, recorded in Volume 4 of Short Plats, page 30, records of Clallam County, Washington being more particularly described as follows: Beginning at the northeast corner of Lot B of Short Plat 77- 12 -12; thence south 88 degrees 10 minutes, 23 seconds east a distance of 10.41 feet to a point 60.0 feet westerly of the easterly margin of the Peabody Street as it is now constructed and in place; thence southerly along a line parallel with, and 60.0 feet westerly of, the easterly margin of the existing Peabody Street to a point that is south 88 degrees, 08 minutes, 04 seconds east a distance of 10.50 feet from the southeast corner of Lot B, Short Plat 77- 12 -12; thence north 88 degrees, 08 minutes, 04 seconds west, a distance of 10.50 feet to said southeast corner of Lot B; thence northerly along the east line of Lot B to a point of beginning. Section 2 - Conditions. 1. A minimum 60 -foot right -of -way from the east line of the improved street to the property line of the subject site shall be reserved by and for the City. Section 3 - Compensation. Compensation required for the vacation of this alley is $ 1,106.11 Section 4 - Quit Claim Deed. The owners of abutting property entitled to the vacated street, pursuant to RCW 35.79.040, may present a quit claim deed to the City of Port Angeles for execution by the Mayor, who is hereby authorized and directed to execute such quit claim deed. Such quit claim deed shall include all reservations, conditions, or other qualifications upon the title established by this Ordinance. Section 5. This Ordinance shall be effective only upon the satisfaction of the terms and conditions of this Ordinance, and the City Clerk is hereby directed to file, record, and publish this Ordinance upon that satisfaction.
