HomeMy WebLinkAbout2788ORDINANCE NO. 2788 AN ORDINANCE of the City of Port Angeles, Washington, revising the licensing requirements for taxicab and for -hire vehicle business operators and drivers and amending Ordinance 2050 and Chapter 5.36 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. A new section 5.36.095 is hereby added to Chapter 5.36 of the Port Angeles Municipal Code to read as follows: Section 5.36.095 Initial Driver's License - Required by: A. All persons, except those holding a current taxicab or for -hire vehicle driver's license issued by the City of Port Angeles, are required to obtain an initial driver's license. B. Licensees who cease, for reasons other than illness or injury, to be actively employed as a taxicab or for -hire vehicle driver for a period in excess of 90 days are required to obtain an initial driver's license. Section 2. Chapter 9, Sections 10, 12 and 13 of Ordinance 2050 and PAMC. 5.36.100, 5.36.120 and 5.36.130 are each amended to read as follows: 5.36.100 Initial Driver's License - Application - Information Required. In addition to all other information required by the City Clerk, the following shall be required: The full name, address, residence, race, age, eelar, height, weight, color of eyes and hair, place of birth, length of time he or she has resided in the Cry State, whether a citizen of the Unitied States, whether previously licensed as a driver or chauffeur, and if so, when and where, and whether such license has ever been revoked and for what cause. Such application shall be signed and sworn to by the applicant and filed with the Chief of Police as a permanent record. Every applicant for a driver's license must submit to fingerprinting, photographing, and a criminal and driver's records check by the Police Department and must file two recent photographs of himoclf cuitablc for attachment to a driver's license. 5.36.120 Initial Driver's License - Fee. The fee for a obtaining the initial driver's license shall be fifteen Dollars thrcc dollars per year plus the cost for Washington State Identification Section inquiry, and the Police Department's fees for fingerprints, photo I.D. , local records check and lamination of the license. The fee is not subject to proration. - 1 - 7 5.36.130 Driver's License - Exhibition Required. Each licensed driver shall wear his or her license prominently displayed on an outer garment and upon the demand request of any police officer or passenger exhibit his or her license and photograph for inspection. Section 3. New sections 5.36.125 and 5.36.210 are hereby added to Chapter 5.36 of the Port Angeles Municipal Code to read as follows: 5.36.125 Driver's License - Term - Renewal - Fee. Taxicab and for -hire vehicle driver's licenses shall be for a period of three -years beginning January 1, 1994 through December 31, 1996 and shall be subject to renewal for three -year periods thereafter. The fee for renewal of a taxicab or for -hire vehicle driver's license shall be fifteen dollars plus the Police Department's fees for photo I.D., local records check and lamination of the license. The fee for license renewal is not subject to proration. 5.36.210 License Denial or Revocation. In addition to grounds supporting denial or revocation of licenses set forth in Chapter 5.04 PAMC, a license may also be denied or revoked upon a finding that: A. Any applicant or licensee has omitted to disclose any material fact necessary to make a statement not misleading in any application for the license; or B. Any for -hire vehicle driver's license applicant or licensee has become disqualified under PAMC 5.36.090 or applicable state law to hold a driver's license for the driving of taxicabs or for -hire vehicles; or C. Any for -hire vehicle business license applicant or licensee fails to report the disqualification of a driver in his or her employ to the City Clerk and Chief of Police. Section 2 - Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 3 - Effective Date. This Ordinance shall take effect five days after publication. - 2 - 1 PASSED by the City Council of the City of Port Angeles at a regular meeting of said Council held on the 1993 . Ordinance No. 2788 This Ordinance of the City of Port Angeles revises the licensing requirements for taxicab and for -hire vehicle business operators and drivers and amends Ordinance 2050 and Chapter 5.36 of the Port Angeles Municipal Code. Ordinance No. 2789 This Ordinance of the City of Port Angeles revises the budget for the fiscal year ending December 31, 1993, establishes wages for 1994, revises certain taxes and fees for 1994, and amends Ordinance 2725. Ordinance No. 2790 This Ordinance of the City of Port Angeles amends solid waste rates effective April 1, 1994, by establishing a singular rate for all landfill users dumping refuse at the sanitary landfill site, and amends Ordinance No. 2317, as amended, and Chapter 13.56 of the Port Angeles Municipal Code.
