HomeMy WebLinkAbout2811ORDINANCE NO. 2 811 AN ORDINANCE of the City of Port Angeles, Washington, annexing approximately 36.78 acres into the City of Port Angeles. WHEREAS, pursuant to RCW 35A.14.120, the necessary petition has been filed with the City of Port Angeles requesting annexation to the City of Port Angeles of an approximately 36.78 acre area which is contiguous to the City; and WHEREAS, the necessary legal steps in connection with the petition have been completed, including the holding of a public hearing on the petition after due and legal notice thereof; and WHEREAS, the requirements of the State Environmental Policy Act, Chapter 43.21C RCW have been met; and WHEREAS, the City Council believes that it is in the best interests of the City and its residents that the petition for annexation be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. The following described area, which is shown in the attached Exhibit "A ", is hereby annexed to the City, subject to the requirements and conditions as set forth in Sections 2, 3 and 4: The SW 1/4 of the NW 1/4, except the East 322.45' of the South 662.40 feet and except the West 160.7 feet of the East 482.1 feet of the South 31.9 feet thereof, and the W 1/2 of the NW 1/4 of the SE 1/4 of the NW 1 /4, Section 13, T 30N, R 6 W.W.M., including those portions of Golf Course Road, Lindberg Road, and Maddock Road adjacent to said properties, Clallam County, Washington. Section 2. The annexed area shall bear a pro rata share of the outstanding indebtedness of the City. Section 3. Pursuant to PAMC 17.95.110, the zoning classification of the annexed area shall be the RS -9, Residential Single - Family District. Section 4. The area shall be annexed subject to the following conditions: Conditions: 1. Compensation shall be provided to the City for obtaining the P.U.D. facilities located within the annexation area in a manner and amount consistent with the recommendation of the Utilities Advisory Committee and City Light. 2. The following road right -of -way shall be obtained prior to the annexation going into effect: a. The east half (30 feet) of Golf Course Road shall be obtained along the south 988 feet of frontage of the annexation site (McCartney, Schmuck and Rone' properties). b. The north half (30 feet) of Maddock Road shall be obtained along those portions of the annexation area where it doesn't currently exist (McCartney, Abraham and Edwards properties). c. Property on Lindberg Road shall be obtained to create the minimum 60 foot wide right -of -way (Heerschap, Ballard, Cooper and Balch properties). 3. Separate no- protest agreements for the formation of a Local Improvement District for each of the following improvements shall be entered into by property owners of no less than 60% of the assessed value of the property within the annexation: Upgrading Lindberg Road, Maddock Road and Golf Course Road to city standards; upsizing the sewer line as outlined in a report prepared by Northwest Territories (NTI); extending the sewer line from its current location north of Melody Lane to the site; and water system improvements for the area including storage and distribution facilities. 4. The south boundary of the annexation shall include the south edge of the Maddock Road right -of -way. 5. The annexed area shall bear the pro rata share of the City's general obligation indebtedness existing as of the date of the annexation. 6. Prior to development of new residential structures or remodel of existing homes by greater than sixty percent, fire hydrants shall be placed within five hundred feet of the structure, to a flow of five hundred gallons per minute, and structures shall be constructed with an automatic sprinkler system. 7. Addressing shall be adjusted between the Owen and Edwards properties to avoid confusion for emergency service response. Section 5. This Ordinance shall take effect five (5) days after date of publication; provided that the City Clerk shall not publish this ordinance or a summary thereof until the Clallam County Boundary Review Board has completed its review of this annexation in accordance with Ch. 36.93 RCW.
