HomeMy WebLinkAbout2825ORDINANCE NO. 2825 AN ORDINANCE of the City of Port Angeles Washington, revising the penalty on delinquent LID assessments and repealing Ordinance No. 1773. WHEREAS, the minimum penalty allowed by state statute to be charged for delinquent local improvement district (LID) assessments is five (5 %) percent; and WHEREAS, in Ordinance No. 1773, adopted on December 5, 1972, the City established the penalty rate for delinquent LID assessments at the statutory minimum of five (5 %) percent; and WHEREAS, recent LID ordinances, particularly those involving bond financing, have established the delinquency penalty rate at twelve (12 %) percent per annum; and WHEREAS, it is in the public interest to establish the general penalty rate for all LID assessments at the rate of twelve (12 %) percent per annum, so that all LID assessments will be treated consistently with each other and will include a sufficient penalty to serve as an incentive to avoid delinquency; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. The amount of any assessment, or any portion thereof, against property in a local improvement district (LID) or utility local improvement district (ULID) of the City of Port Angeles not paid within the thirty (30) day period from the date of a first publication of a notice from the Finance Director or designee shall be subject to interest on the diminishing principal balance thereof at the rate of interest established by ordinance for the LID or ULID. Interest shall commence on the thirtieth (30th) day following first publication of such notice and shall continue until all installments are paid in full. The first installment shall become due and payable one year from the expiration of the thirty (30) day prepayment period. Annual installments, including interest and penalty, shall be paid in full when due, and no partial payment shall be accepted by the Finance - 1 - Director or designee. Section 2. Any installment of the principal of and interest on any assessment now or hereafter levied in any local improvement district or utility local improvement district of the City of Port Angeles, which is not paid on or prior to the date on which such installment is due and payable, shall thereafter be deemed delinquent. All delinquent installments shall be subject to a penalty equal to twelve (12 %) per annum of the amount of both principal and interest due upon such installment or installments from the date of delinquency until paid. Collection of such delinquent installments shall be enforced in the manner provided by law. Section 3. The lien of any assessment may be discharged at any time after the thirty (30) day prepayment period by payment of the entire principal amount of the assessment remaining unpaid together with interest and any penalty thereon to the due date of the next installment. Section 4. Ordinance No. 1773 is hereby repealed. Section 5. - Effective Date. This Ordinance shall take effect five days after the date of publication. Ordinance No. 2824 This Ordinance of the City of Port Angeles revises an annexation condition for property near Golf Course Road. This Ordinance amends Section 4 of Ordinance 2774. Ordinance No. 2825 This Ordinance of the City of Port Angeles pertains to the revision of penalties on delinquent LID assessments by establishing a general penalty rate for all LID assessments at the rate of 12% per annum. This Ordinance repeals Ordinance No. 1773. Ordinance No. 2826 This Ordinance of the City of Port Angeles revises the City Pier and Waterfront Park regulations by requiring all operators of vessels mooring overnight to self register and pay a moorage fee of $8.00 per night. This Ordinance amends Ordinance No. 2209, as amended, and Chapter 12.12 of the Port Angeles Municipal Code.
