HomeMy WebLinkAbout2830ORDINANCE NO. 2830 AN ORDINANCE providing for the submission to the qualified electors of the City of Port Angeles at a special election to be held on September 20, 1994, of a proposition authorizing the City to issue its general obligation bonds in the aggregate principal amount of not to exceed $3,600,000, or so much thereof as may be issued under the laws governing the indebtedness of cities, for the purpose of providing funds to construct and equip a new library building of the City to be located on E. Lauridsen Blvd., and a proposition authorizing the City, if the new llbrary bonds are approved, to issue its general obligation bonds in the aggregate principal amount of not to exceed $300,000, or so much thereof as may be issued under the laws governing the indebtedness of cities, fbr the purpose of providing funds to renovate for other City purposes the existing library building of the City located on S. Lincoln Street. WHEREAS, pursuant to RCW 27.12.025, the City of Port Angeles, Washington (the "City "), is authorized to establish and maintain a public library, either by itself or in cooperation with one or more other governmental units, which cooperation may take the form of a regional library, pursuant to RCW 27.12.080; and WHEREAS, the City has entered into an agreement with Clailam County, Washington, for the formation of a regional library known u the North Olympic Library System (the "Library"), under which agreement the City provides a building within the boundaries of the City for the operation of a public library by the Library; and WHEREAS, the existing library building located at 207 S. Lincoln Street within the City is inadequate for continued operation as a public lbrary, and the beat interests of the inhabitants of the City require the City to construct and equip a new library building to be located on F. Lauridsen Boulevard within the City (the "New Library Project "); and WHEREAS, to provide financing for the New Library Project it is deemed necessary and advisable that the City issue and sell its unlimited tax levy general obligation bonds in the principal amount of not to exceed $3,600,000; and WHEREAS, if the New Library Project is completed, the building located at 207 S. Lincoln Street will no longer be used by the Library and will be available for other City purposes, and, in that event, the best interests of the inhabitants of the City will require the City to renovate the building before it can be used for any such City purposes; and WHEREAS, to provide financing for the construction and equipping of such improvements as will be required to renovate the existing library building (the "Former Library Project ") it is deemed necessary and advisable that the City issue and sell its unlimited tax levy general obligation bonds in the principal amount of not to exceed $300,000; and WHEREAS, the constitution and laws of the State of Washington provide that the question of whether or not the City may issue such bonds be submitted to the qualified electors of the City for their ratification or rejection; and WHEREAS, the Council wishes to condition approval of the Former Library Project bonds on approval by the voters of the New L lbrary Project bonds; NOW, TI 1•d ORE, THE CITY OP PORT ANGELES, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Findings; Authorization pr Projects. A. New Library Proj. The City Council (the "Council ") hereby finds that the best interests of the inhabitants of the City require the City to construct and equip a new library building of approximately 25,000 square feet (the New Library Project "), at the time or times, and in the manner deemed most necessary and advisable by the Council. The new library building shall be located in the City of Port. Angeles on a site currently owned by the North Olympic Library System (the "Library "). The site is adjacent to the administrative center for the Library located on E. Lauridsen Boulevard. Pursuant to an interlocal agreement between the City and the Library, the Library will lease this site to the City for construction of the new library building, and the City will lease the completed library building and site back to the Library. 2 The cost of all necessary architectural, engineering and otter consulting services, inspection and testing, administrative and relocation expenses, on- and off-site utilities, incidental costs and costs related to the sale and issuance of the bonds and other costs incurred in connection with the making of the foregoing capital improvements shall be deemed a part of the costs of such improvements. Such improvements shall be complete with all necessary furniture, equipment and appurtenances. The estimated cost of the New Library Project, including the cost of issuing and selling the bonds provided in this ordinance, is declared to be, u nearly as may be determined, the amount of $3,900,000, of which amount S3,600,000 shall be provided from the proceeds of the New Library Project bonds authorized herein.. The City shall determine the application of available moneys with respect to the New Library Project so as to accomplish, as nearly as may be, all improvements described or provided for in this section. The City shall determine the exact extent and specifications for construction of structures or other improvements. If the Council, by ordinance, shall determine that it has become impractical to accomplish any portion or portions of the New Library Project by reason of changed conditions or needs, or costs substantially in excess of the amount of bond proceeds or tax levies estimated to be applied thereto, the City shall not be required to accomplish such improvements and may apply bond proceeds as set forth in this section. If the New Library Project has been completed, its completion duly provided for, or its completion found to be impractical, the City may apply the bond proceeds or any portion thereof to other library improvements or to other capital improvements of the City, or to payment of principal of or interest on the bonds, as the Council, by ordinance and in its discretion, shall determine. In the event that the proceeds of sale of the bonds, plus any other moneys of the City legally available, are insufficient to accomplish all of the capital improvements provided by this section, the City shall use the available funds for paying the cost of those improvements for which 3 the bonds were approved deemed by the Council most necessary and in the best interest of the City. B. Former Library Project. If the New Library Project is completed in substantially the form described above, the building located at 207 S. Lincoln Street will no longer be used by the Library and will be available for other City purposes. The Council hereby finds that, in such event, the best interests of the inhabitants of the City require the City to construct and equip improvements to renovate such building (the "Former Library Project "), at the time or times, and in the manner deemed most necessary and advisable by the Council. Authorization of Bonds A. New Library Project Bonds. For the purpose of providing part of the funds necessary to pay the costs of the New Library Project, the City shall issue and sell its general obligation bonds in the aggregate principal amount of not to exceed 33,600,000. Such bonds shall be issued in an amount not exceeding the amount approved by the qualified electors of the City or exceeding the amount permitted by the constitution and laws of the State of Washington. The balance, if any, of the cost of the New Library Project shall be paid out of any money that the City now has or may later have on hand that is legally available for such purposes and from funds provided by the Library. B. Former Llrary Project Bonds. For the purpose of providing part of the funds necessary to pay the costs of the Former Library Project, the City shall issue and sell its general obligation bonds in the aggregate principal amount of not to exceed $300,000, but only if the issuance and sale of the New Library Project bonds described above are approved by the electors of the City, as provided herein. Such bonds shall be issued in an amount not exceeding the amount approved by the qualified electors of the City or exceeding the amount permitted by the constitution and laws of the State of Washington. The balance, if any, of the cost of the Former 5 Library Pmject shall be paid out of any money that the City now has or may later have on hand that is legally available for such purposes and from funds provided by the Library. C. Details of the Bonds. The bonds authorized herein shall be issued in such amounts and at such time or times as found necessary and advisable by the Council. The bonds may be issued in one or more series and shall bear interest payable at a rate or rates not to exceed the maximum rate permitted by law at the time the bonds are sold, and shall mature in such amounts and at such times within a maximum term of 20 years from date of issue, but may mature at an earlier date or dates as authorized by the Council and as provided by law. The exact date, form, terms, options of redemption, maturities and conditions of sale of the bonds shall be as hereafter fixed by ordinance of the Council passed for such purpose. The bonds shall be general obligations of the City and, unless paid from other sources, both principal of and interest on the bonds shall be payable out of annual tax levies to be made upon all the taxable property within the City without limitation as to rate or amount. After voter approval alone or both of the bond propositions and in anticipation of the issuance of such bonds, the City may issue short term obligations as authorized by Chapter 39.50 RCW, ,Section 3. Bond Election, It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the City of propositions authorizing the City to issue bonds for the purposes set forth in this ordinance at a special election to be held on the 20th day of September, 1994. The Clallam County Auditor, as ex officio supervisor of elections, is hereby requested to find the existence of such emergency and to assume jurisdiction of and to call and conduct said special election to be held within the City and to submit to the qualified electors of the City the propositions hereinafter set forth. The City Clerk is hereby authorized and directed, not less than 45 days prior to September 20, 1994, to certify the following propositions to the Claiam County Auditor in the following form: 6 CITY OF PORT ANGELES PROPOSITION NO. 1 GENERAL OBLIGATION BONDS - $3,600,000 To construct and equip a new library building on property leased from the North Olympic Library System adjacent to its admimstrative center on E. Lauridsen Blvd., shall the City of Port Angeles issue $3,600,000 of general obligation bonds, maturing within a maximum term of 20 years, and shall annual property tax levies in excess of regular property tax levies be authorized to pay principal and interest on such bonds, as provided in Ordinance #, BONDS BONDS Yes No PROPOSITION NO. 2 GENERAL OBLIGATION BONDS - $300,000 If Proposition No. 1 is approved, authorizing bonds for a new library, shall the City of Port Angeles also issue $300,000 of general obligation bonds, maturing within a maximum term of 20 years, to renovate, for other City purposes, the existing library building on S. Lincoln Street, and shall annual property tax levies in excess of regular property tax levies be authorized to pay principal and interest on such bonds, as provided in Ordinance # 7 BONDS Yes ❑ BONDS No The polls for such special elation shall be open from 7:00 a.m. to 8:00 p.m, The City Clerk is hereby authorized and directed to deliver a certified copy of this ordinance to the Clallam County Auditor. 5Qctign 4. Sev_eability In the event any one or more of the provisions of this ordinance shall for any reason be held to be invalid, such invalidity shall not affect or invalidate any other 7 provision of this ordinance or the bonds, but this ordinance and the bonds shall be construed and enforced as if such invalid provision had not been contained herein; provided, that any provision which shall for any reason be held by reason of its extent to be invalid shall be deemed to be in effect to the extent permitted by law. Section 5. Effective bate. This ordinance shall become effective five days after its passage and publication, as required by law. The property is legally described as that portion of Suburban Lot 10 lying south of First Street to the First /Second Street alley, between Liberty and Ennis Streets, Port Angeles, Washington, County of Clallam, except the east two hundred feet thereof. Ordinance No. 2828 This Ordinance of the City of Port Angeles establishes a pay plan for the employees represented by IBEW #997 for the period of April 1, 1994 through March 31, 1995, and provides for the payment thereof. Ordinance No. 2829 This Ordinance of the City of Port Angeles establishes a pay plan for the employees represented by Teamsters Local #589 (non -sworn unit) for the period of January 1, 1994 through December 31, 1994, and provides for the payment thereof. Ordinance No. 2831 This Ordinance of the City of Port Angeles exempts the City from a new legislative prohibition against the carrying of firearms in certain situations and adds a new section to Chapter 9.42 of the Port Angeles Municipal Code.
