HomeMy WebLinkAbout2863ORDINANCE NO, 286 3 AN ORDINANCE of the City of Port Angeles amending Ordinance No. 1709, as amended, adding Sections 17.96.045 and 17.08.130(C) to the Port Angeles Municipal Code relating to zoning lot covenants, and amending Section 17.22.200 relating to setback requirements in the CSD, Community Shopping District. WHEREAS, following public hearings before the Planning Commission and City Council on proposed amendments to the City's zoning regulations concerning zoning lot covenants and setback requirements in the CSD, Community Shopping District, the City Council adopted Ordinances 2848, 2853, and 2856; and WHEREAS, said Ordinances need to be re- enacted, because the zoning code amendments they adopted were not included in the comprehensive zoning code amendment enacted on March 7, 1995, as Ordinance 2861; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. Ordinance 1709, as amended, and Chapter 17.96 of the Port Angeles Municipal Code are hereby amended by adding PAMC Section 17.96.045 to read as follows: 17.96.045 Zoning Lot Covenants - Applicability. Zoning lot covenants. as defined in PAMC 17.08.130(C). may be used only to allow a property owner to designate as a zoning lot two or more adjacent lots that either: A. Have one legal residential structure encroaching onto all of the said lots: or B. Results in a lot that meets the zoning and subdivision requirements; or C. Results in a lot that does not meet the zoning and subdivision requirements, provided that the owners sign a no- protest agreement for the formation of an L.I.D. for meeting the development standards. The covenant shall be recorded with the County Auditor's Office and a copy of the recorded covenant shall be provided to the Planning Department. Once filed. the covenant may only be removed through compliance with Chapter 58.17 RCW and the City's subdivision and /or short plat regulations. Section 2. Ordinance No. 1709, as amended, and Chapter 17.08 of the Port Angeles Municipal Code are hereby amended by amending PAMC 17.08.130 to read as follows: 17.08.130 "Z" A. Zone - an area defined as to boundaries and location, and classified by the Zoning Regulations as available for certain types of uses, and which other types of uses are excluded. B. Zoning Lot - a single tract of land located within a single block, which at the time of filing for a building permit, is designated by its owner or developer, as a tract 11 to be used, developed, or built upon as a unit, under single ownership or control. A zoning lot may or may not coincide with a lot of record. C. Zoning Lot Covenant - an agreement.on a form provided by the Planning Department. which is recorded at the County Auditor's Office by a property owner of two or more adjacent lots and which designates said lots as a single. inseparable building lot. Section 3. Ordinance No. 1709, as amended, and Chapter 17.22 of the Port Angeles Municipal Code are hereby amended by amending PAMC 17.22.200 to read as follows: 17.22.200 Development Standards. A. Area and Dimensional Requirements: 1. Minimum Lot Area 7,000 square feet. 2. Minimum Lot Width 50 feet. 3. Minimum Yard Requirements No structure shall be built within 15 feet of an alley that abuts a residential zoning classification or of any property that has a residential zoning classification. Setbacks shall conform to the requirements of Ordinance No. 1635 for arterial streets. No loading structure or dock with access onto the alley shall be built within 15 feet of an alley. Driveway access onto an alley shall maintain a vision clearance triangle. The vision clearance triangle shall extend 10 feet along the alley and 15 feet along the edge of the driveway. measured from the point of intersection of each side of the driveway and the alley right -of -way line. 4. Maximum Lot Coverage - 50% of the total site area. 5. Maximum Height - 30 feet. Section 4. This Ordinance shall become effective five (5) days after the date of publication. Kn tson, City Attorney PUBLISHED April 9, 1995 13y Summary 2 JMAYOR 1 Summaries of Ordinances Adopted by the Port Angeles City Council on April 4, 1995 Ordinance No. 2862 This Ordinance of the City of Port Angeles amends Ordinance 1709, as amended, and adds Section 17.94.155 to the Port Angeles Municipal Code to regulate the parking of commercial vehicles in residential zones where no owner or occupant of land abutting a public street, which land or street is in a residential zone or is the boundary of a residential zone, may use such street for the habitual or overnight parking or storage of commercial motor vehicles or trailers, excepting the parking on the street of one commercially used vehicle which is driven to and from the work place by the owner or occupant of the dwelling unit. Ordinance No. 2863 This Ordinance of the City of Port Angeles amends Ordinance No. 1709, as amended, adding Sections 17.96.045 and 17.08.130(C) to the Port Angeles Municipal Code relating to zoning lot covenants, and amends Section 17.22.200 relating to setback requirements in the CSD, Community Shopping District.
