HomeMy WebLinkAbout2888ORDINANCE NO. 2888 AN ORDINANCE of the City of Port Angeles, Washington, modifying the system development charge for recovering capital costs of water and sewer facilities, eliminating the secondary sewer assessment charge, amending Ordinance 2746, repealing Ordinance 2572, as amended, and amending Chapter 13.69, and repealing Chapter 13.66, of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Section 3 of Ordinance 2746 and PAMC 13.69.030 are hereby amended to read as follows: 13.69.030 Water System Development Charge. A. The City Council hereby finds and determines that the capital cost of the City's water system including pumps, well, distribution and transmission lines, reservoirs, rights of ways and easements as of December 31, 1992-4, is $10,232,35857,318,849. The capital cost of such system has been borne by the City and its water system users. Such water system will be utilized by newly connecting properties, and the capital cost as applied to customers presently served is equivalent to $1 ,5035,586 per equivalent water meter. B. The City Council further determines that due to the varying ages of the system's facilities, -5615.8% of the above specified equivalent water meter dollar allocations or $750-883.00 per equivalent water meter represents a reasonable basis for a fair water system development charge that property owners newly connect- ing to the City's water system should bear as their equitable share of the capital cost of the system. C. In addition to other fees imposed by ordinance or pursuant to agreements, there is hereby imposed, upon the owners of property seeking to provide water service to their property by connecting to the City's water system, a water system development charge determined by multiplying the total number of equivalent water meter factors for the service(s) to be installed by $750883.00. Section 2. Section 4 of Ordinance 2746 and PAMC 13.69.040 are hereby amended to read as follows: 13.69.040 Sewer System Development Charge. A. The City Council hereby finds and determines that the capital cost of the City's sewer system including the treatment plant, collection lines, pump stations, rights of ways and easements as of December 31, 1992.4, is $1,115,43139,588,312. The capital cost of such system has been borne by the City and its sewer system users. Such sewer system will be utilized by newly connecting properties, and the capital cost as applied to customers presently served is equivalent to $649.004,066.00 per equivalent water meter. B. The City Council further determines that due to the varying ages of the system's facilities, -5815.8% of the above specified equivalent water meter dollar allocations or $324642.00 - 1 - per equivalent water meter represents a reasonable basis for a fair sewer system development charge that property owners newly connect- ing to the City's sewer system should bear as their equitable share of the capital cost of the system. C. In addition to other fees imposed, by ordinance or pursuant to agreements, there is hereby imposed, upon the owners of property seeking to provide sewer service to their property by connecting to the City's sewer system, a sewer system development charge determined by multiplying the total number of equivalent water meter factors for the water service, which contributes to sewer system loadings, to be installed by $324642.00. Section 3. Ordinance 2572, as amended by Ordinance 2690, and Chapter 13.66 of the Port Angeles Municipal Code are hereby repealed. Section 4 - Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 5 - Effective Date. This Ordinance shall take effect five days after publication. The full text of the Ordinance is available at City Hall in the City Clerk's office or will be mailed upon request.
