HomeMy WebLinkAbout2893ORDINANCE NO. 2893 AN ORDINANCE of the City of Port Angeles, Washington, pertaining to the creation of accounts receivable and amending Ordinance 2112 and Chapter 3.64 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Section 1 of Ordinance 2112 and Section 3.64.010 of the Port Angeles Municipal Code are hereby amended to read as follows: 3.64.010 Purpose. The City Council finds it necessary to provide a procedure for the collection of contractual accounts receivable for City services and fees. In order to effectuate such collection, the Council deems it necessary and appropriate to provide bolls for the imposition of an interest charge on delinquent payments, and to allow the City to refuse to grant certain services to persons with delinquent accounts, and to require the completion and approval of a credit application prior to authorization of accounts receivable. The City Council further finds it necessary and appropriate to provide for the imposition of an interest charge on amounts due the City on noncontractual claims. (Ord. 2112 §1, 1/18/81) Section 2. Section 2 of Ordinance 2112 and Section 3.64.020 of the Port Angeles Municipal Code are hereby amended to read as follows: 3.64.020 Definitions. A. "City" means the City of Port Angeles. B. "Person" means any person, corporation, association, partnership, venture, society, club or organization whatsoever. C. "Responsible Official" means the City Manager, Finance Director, or his their designee. (Ord. 2112 §2, 1/18/81) Section 3 Section 3 of Ordinance 2112 and Section 3.64.030 of the Port Angeles Municipal Code are hereby amended to read as follows: 3.64.030 Creation of Accounts Authorized - Alternative. A. The Responsible Official may authorize creation of an account receivable for any person requesting services from the City for which a fee is charged, or making application to the City for a permit for which a fee is charged. B. Prior to authorizing an account receivable, the Responsible Official shall require the completion and approval of a credit application and payment of a $40.00 credit check fee. C B. In lieu of authorizing an account under subsection A B, the Responsible Official may require a cash deposit, in an amount estimated to be sufficient to assure payment of the estimated amount of the fee to be due to the City. Such deposit shall be placed by the City into a noninterest bearing trust account, and shall only be withdrawn therefrom at the time of full payment of the fee. D. Should an account receivable for which a deposit has been made become delinquent, the City may remove so much of the deposit from the trust account as is necessary to fully pay the fee. The remainder, if any, of the deposit shall be returned to the depositor. E. A person required to make a deposit under this Section may authorize payment of the fee to the City from the deposit, in writing, at the time the deposit is made. (Ord. 2112 §3, 1/18/81) Section 4. Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 5. Effective Date. This Ordinance shall take effect five days after publication. Ordinance No. 2893 This Ordinance of the City of Port Angeles pertains to the creation of accounts receivable by requiring the completion and approval of a credit application and payment of a $40.00 credit check fee and amends Ordinance 2112 and Chapter 3.64 of the Port Angeles Municipal Code. Ordinance No. 2894 This Ordinance of the City of Port Angeles establishes landfill disposal rates for commercial loads of debris capable of being composted and amends Ordinance 2317, as amended, and Chapter 13.56 of the Port Angeles Municipal Code.
