HomeMy WebLinkAbout2910ORDINANCE NO. 2910 AN ORDINANCE of the City of Port Angeles, Washing- ton, adopting the current editions of the Uniform Building Code, Uniform Fire Code and other related codes, adopting local amendments to said codes, increasing permit fees, revising electrical permit requirements, and amending Ordinance 2552, as amended, and Chapters 14.01, 14.03, 14.05, and 14.21 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Ordinance 2552, as amended, and Chapter 14.03 PAMC are hereby amended by amending PAMC 14.03.010, .020, and .040 to read as follows: 14.03.010 Uniform Codes Adopted. Pursuant to Chapters 19.27 and 19.27A RCW and Title 51 WAC, the following Codes are adopted subject to the amendments set forth in Title 14 PAMC: A. The Uniform Building Code, including Appcndix,Table 1A of Chapter 1, except subsection 110(b), Appendix Chapters 3, 4, 11, 15, 18, 23 and 317, 10, 25, 29, 31, 32, and 45, 1994 Edition and Uniform Building Code Standards, 1994 Edition, published by the International Conference of Building Officials, as amended by the Washington State Building Code Council and published as Chaptere 51 -430 and 51 21 Washington Administrative Code; B. The Uniform Mechanical Code, 1994 Edition, including Table 1A of Chapter 1 and Chapter 4413, Fuel Gas Piping, Appendix B, published by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, as amended by the Washington State Building Code Council and published as Chapter 51 -2-32 Washington Administrative Code. C. The Uniform Fire Code, 19944 Edition and Uniform Fire Code Standards, 19944 Edition, published by the International Conference of Building Officials and the Western Fire Chiefs Association, as amended by the Washington State Building Code Council and published as Chapters 51 -434 and 51 -435 Washington Administrative Code, except as amended in Chapter 14.21 PAMC; D. The Uniform Plumbing Code, including Table 1 -1 of Chapter 1, 1994 Edition, and Uniform Plumbing Code Standards, 1994 Edition, published by the International Association of Plumbing and Mechanical Officials, as amended by the Washington State Building Code Council and filed as Chapter 51 -26 Washington Administrative Code; E. The Washington State Ventilation and Indoor Air Quality Code, as adopted by the Washington State Building Code Council and filed as Chapter 51 -13 Washington Administrative Code; F. The Washington State Energy Code, 1994 Second Edition, as amended by the Washington Building Code Council, and filed as Chapter 51 -11 Washington Administrative Code; G. The Uniform Sign Code, 1994 Edition, published by the International Conference of Building Officials; 1 H. The Uniform Code for the Abatement of Dangerous Buildings, 199-1-4 Edition, published by the International Conference of Building Officials; I. The Washington State Historic Building Code, First Edition, published by the Washington State Building Code Council as Chapter 51 -19 Washington Administrative Code. In case of conflict among the codes enumerated in sub- sections A through D of this Section, the earlier named Code shall govern over those following. 14.03.020 Amendments to Uniform Codes. Pursuant to RCW 19.27.040, RCW 19.27.060(3) and (4), and PAMC 14.04.020, the following amendments to the Uniform Building Code, Uniform Plumbing Code, and Uniform Sign Code are adopted: A. Uniform Building Code, Chapter 5, Table 5 -GB is amended by adding the following footnote: (9) Type V -N construction prohibited in CBD - Central Business District. B. Uniform Building Code, Section 3802(b)904.2.2 is amended by adding the following: &6. Automatic sprinklers shall be provided: (a) In all buildings where the floor area exceeds 6250 square feet on all floors (b) In any adult family home, boarding home, or group care facility that is licensed by the Washington State Department of Social and Health Services for more than five persons; hHowever, the area and height increases specified in Section 506(C)505.3 and 507506 (for sprinklers) shall be permitted. For the purpose of this subsection, portions of buildings separated from the rest of the building, in accordance with Section 5- 5(c)504.5, with openings allowed by the Uniform Building Code protected by the installation of approved magnetic hold -open devices which are activated by smoke detection devices installed on both sides of said openings, may be considered as separate buildings. C. Uniform Building Code, Section 106.3.1 is amended by adding the following: 8. State the name and certification identification number of the certified manufactured home installer supervising the installation of a mobile or manufactured home. D. Uniform Building Code, Section 106.4.1 is amended by adding the following: The following requirements shall apply to building permits for mobile or manufactured homes that are required by the State to be installed by a certified installer. The building permit shall state the name and certification number(s) of the certified manufactured home installer(s) supervising the installation. The permit shall not be issued until the installer submits a copy of the certificate of - 2 - manufactured home installation to the City. Work shall not commence until the installer or its agent has posted or otherwise made available a copy of said certificate with the inspection record at the set -up site. GE. Uniform Building Code, Appendix Chapter 32-15, Section 32011517.5, is amended to require that all cedar shingles be removed prior to any reroof. F. Uniform Plumbing Code, Appendix C, is amended to add Footnote 15 as follows: Required restroom facilities shall be maintained open and operable during business hours where businesses are being conducted and in other buildings when being used by employees, occupants, or the public. Such public restrooms shall be readily identifiable. EG. Uniform Sign Code, Chapter 3, Section 301, is amended by adding the following: Provided, that presently existing signs not in conformity with this code, as amended, may be maintained in their present condition unless hazardous, but may not be altered or reconstructed unless in conformity with this code. PH. Uniform Sign Code, Chapter 3, Section 303: Delete #3, signs less than 61- feet above grade. GI. Uniform Sign Code, Chapter 4, delete Table 4 -B. In lieu thereof, Chapter 4532, Section 1.505(b)3205.1 of the Uniform Building Code, 1994 Edition, shall apply to projection of signs. 14.03.040 Fees. The fees set forth in the codes adopted in PAMC 14.03.020 shall apply in all instances except for the following: A. The fee for plan review shall be as follows: 1. Residential: 400 of the Building Permit fee. 2. Commercial: 65% of the Building Permit fee. AB. The permit fee for the installation of a modularmanu- factured or mobile home shall be $200. EC. The mechanical permit fee for installation of a solid fuel burning appliance shall be $75. GD. Sign permit fees shall be according to the schedule set forth in this subsection. 1. Sign Permit Fee Schedule Type of Sign Fee Wall or marquees, over 25 sq. ft. $ 75 Freestanding and projecting, over 25 sq. ft. $100 All signs less than 25 sq.ft. $ 25 Supergraphic on building (any size) $ 25 2. If the work authorized under a sign permit has not been completed within 180 calendar days after the date of issuance of the permit, the permit shall expire and any subsequent - 3 - work shall require a renewal of the permit and payment of renewal fees, at one -half the original fee. All fees are nonrefundable. 3. Any person, firm, or corporation who shall erect, re- erect, construct, alter, or maintain a sign without a permit first having been obtained, except as provided by the Port Angeles Municipal Code, shall as a penalty pay double the amount required by the Sign Permit Fee Schedule. DE. Surcharges enacted pursuant to Chapter 19.27 RCW and remitted to the State Treasurer shall be $4.50 for each building permit, plus $2 for each additional residential unit. ErF. The inspection fee for call -back plumbing inspections shall be $10. FG. Section 2. Ordinance 2552, as amended, and Chapter 14.21 PAMC are hereby amended by amending PAMC 14.21.010, .025, .040, .050, and .060, and adding PAMC 14.21.035, to read as follows: 14.21.010 Adoption of Uniform Fire Code, Appendices, and Standards. There is adopted by the City Council for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain Code known as the Uniform Fire Code Volume I, including Appendices I -A, II -B, C, F, III -A, B, C, IV -B, V -A, and VI -A, and Uniform Fire Code Standards Volume 2, 1994 Edition, published by the International Conference of Building Officials and the Western Fire Chiefs Association, as amended by the Washington State Building Code Council and published as Chapter 51 -2-34 and 51 -2.35 WAC; provided, that Sections 10.202, 10.203, 10.204, 10.205, 10.206.902.2 through 902.4.1 shall not be deleted and, notwithstanding any wording in said Code, participants in religious ceremonies shall not be precluded from carrying hand- held candles; and provided further, that Article 78, Fireworks, is deleted in its entirety. 14.21.025 Inspection Fees. When the following inspections are required to be performed pursuant to the Uniform Fire Code, the fees for such inspections shall be as set forth below: 1.A. Welding and cutting inspections for activities of the following duration: 1. Up to 5 days 2. 6 to 30 days 3. 31 to 90 days 4. 91 to 180 days 5. 181 to 365 days $ 50.00 $100.00 $200.00 $300.00 $500.00 Welding and cutting activities extending beyond one year shall be required to renew any required permits and pay inspection fees in accordance with the above schedule. l.B. Marine fueling operations inspections $ 25.00 Reinspections $ 15.00 l.C. Place of assembly inspections $ 25.00 l.D. Liquid petroleum gas tank and piping installation and inspection $ 25.00 2. The following fees shall be a one (1) time fee for ini- tial installation plan review and inspection. 2.A Underground storage tank removal and installation inspection: commercial $100.00 residential $ 15.00 2.B Automatic fire sprinkler installation inspection and testing: multi-family_ $ 50.00 commercial $100.00 2.0 Fire alarm plan review $ 50.00 2.D Fire alarm installation inspection and testing: $100 plus $10 for each additional zone 2.E Hood /duct system plan review $ 15.00 2.F Hood /duct system inspection and test $ 25.00 Section 14.21.030 Aboveground Storage of Flammable Liquids. A. The limits referred to in Section 79.5017902.2.2.1 of the Uniform Fire Code, in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited, are established in all zones except in the ACD, CBD, CSDC1, and CSDC2 zones, where the maximum quantity shall be 24,000 gallons, and the M -2 zone adjacent to Port Angeles Harbor. B. The limits referred to in Section 79.14017904.4.1 of the Uniform Fire Code, in which new bulk plants for flammable or combustible liquids are prohibited, are established as follows: In all zone classifications except that part of M -2 which lies west of Cedar Street as prescribed in Ordinance 1709 and subsequent ordinances amending the same. Section 14.21.035 Hazardous Materials. In determining the amount of costs associated with the cleanup of an unauthorized discharge, which costs are to be born by the owner, operator or other person responsible for the unauthorized discharge, the fire department shall charge fees for the cost of equipment and manpower utilizing the Washington State Association of Fire Chiefs recommended rate schedule. 14.21.040 Bulk Storage of Liquefied Petroleum. A. The limits referred to in Section 82.104(b)8204.2 of the Uniform Fire Code, in which bulk storage of liquefied petroleum gas is restricted, are established as follows: In all zone classifications except that part of M -2 which lies west of Cedar Street as prescribed in Ordinance 1709 and subsequent ordinances amending the same. B. The liquified petroleum gas container requirements referred to in Article 82 of the Uniform Fire Code shall include the requirement that containers be protected from damage that might result from earthquakes, the manner and extent of which protection shall be in accordance with the determination of the fire chief. 14.21.050 Storage of Explosives. The limits referred to in Section 77.107(a)7701.7.2 of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are - 5 - established as follows: In all zone classifications except that part of the M -2 zone which lies west of Cedar Street as prescribed in Ordinance 1709 and subsequent ordinances amending the same. 14.21.060 Open Burning Limitations - Burning Permits Required. A. No garbage, dead animals, or materials containing asphalt, petroleum products, paint, rubber products, plastics paper (other than what is necessary to start a fire), cardboard, treated wood, construction debris, metal, or any substance which emits dense smoke, toxic emissions, or obnoxious odors will be allowed to be burned. B. Natural vegetation such as brush, leaves and tree trimmings, may be burned upon private property in accordance with the regulations of the Port Angeles Fire Department upon obtaining a permit from the Fire Department as provided in Sections C and D. C. A one -day permit for open burning of natural vegetation for a fire that will be no larger than four feet in diameter shall be issued without charge by the Port Angeles Fire Department verbally, by contacting the Fire Department at 457 -0411, extension 255, and leaving the applicant's name and address. D. A written permit, good for a five -day period, is required for open burning of natural vegetation for a fire that will be larger than four feet in diameter and shall be issued only upon completion of an on -site inspection, scheduled 24 hours in advance, by Fire Department personnel. The fee for said permit is $25.00 for fires up to ten feet in diameter and $80.00 for fires between ten and twenty feet in diameter. The permit period may be extended for a reasonable period for good cause. The written copy of the open burning permit and regulations shall be maintained on site at all times during burning operations. Each fire permitted pursuant to this subsection shall require a separate permit, shall consist of a single pile not to exceed twenty feet in diameter, and shall comply with the following requirements: 1. The permittee must have someone in constant attendance at the burn pile along with necessary equipment as required by the fire department; 2. The permittee must have a means of communicating with the Fire Department; 3. Two fans must be used; 4. Prior to lighting the burn pile, one week's written notice must be provided by the permittee to homeowners and businesses in the immediate neighborhood, which notice must include the date, time and duration of the controlled burn and the name and phone number of the permittee; 5. Residents of the affected area who could experience documented respiratory distress from the smoke emissions that could be detrimental to their health shall be relocated at the expense of the permittee as mutually agreed upon by the permittee and the affected resident; 6. The fire shall be extinguished if the smoke or ash unreasonably interferes with a neighbor's property use and enjoyment or could be detrimental to the health of someone who does not want to be relocated as determined by the Fire Chief or other designated City official; 7. Before being burned, the natural vegetation from a land - clearing site shall be required to dry to the minimum level - 6 - necessary to facilitate clean burning as determined by the Fire Chief or other designated City official; 8. Burning shall not occur when weather conditions are such that an inversion layer would be created. Section 3. Ordinance 2552, as amended, and Chapter 14.05 of the Port Angeles Municipal Code are hereby amended by amending PAMC 14.05.070 to read as follows: 14.05.070 Electrical Permit to the Owner. An electrical permit to perform electrical work in or on the owner's residence or structure may be issued to the owner, provided the following conditions are satisfied: 1. The electrical work shall be done by the owner of the property. 2. If requested, the owner shall sign an affidavit stating that he or she is the owner of the property and that he or she will be doing the electrical work. D. An electrical permit to perform electrical work in or on a commercial occupancy building or commercial s- tructurc will only bc iaaucd to a qualified electrical contractor or to the owner if and commercial structures that arc part of a residence will bc tr atcd as a rcaidcntial atructurc. Section 4 - Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 5 - Effective Date. This Ordinance shall take effect five days after publication. This Ordinance also relates to requirements for final plat approvals which would ensure that final building setbacks are shown on all final plat submittals, and amends Ordinances 2222 and 1631, as amended, and Chapters 16.04 and 16.08 of the Port Angeles Municipal Code. Ordinance No. 2910 This Ordinance of the City of Port Angeles adopts the current editions of the Uniform Building Code, Uniform Fire Code and other related codes, adopts local amendments to said codes, increases permit fees, revises electrical permit requirements, and amends Ordinance 2552, as amended, and Chapters 14.01, 14.03, 14.05, and 14.21 of the Port Angeles Municipal Code.
