HomeMy WebLinkAbout2919ORDINANCE NO. 2919 AN ORDINANCE of the City of Port Angeles, Washington, revising the requirements for final approval of planned residential developments and amending Ordinance 2038 as amended and Chapter 17.19 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Ordinance 2038, as most recently amended by Ordinance 2861, and Chapter 17. 19.140 of the Port Angeles Municipal Code are hereby amended by amending PAMC 17.19.140 to read as follows: 17.19.140 Final Approval of Planned Residential Development. Application for final approval of the Planned Residential Development shall be submitted within one year of the approval of the preliminary development plan— ; provided that for phased PRD's each phase shall have an additional one -year period for final approval; and provided further that an applicant may apply to the Planning Commission, and the Commission may approve, one or more one -year extensions as the Commission may deem appropriate. The site must be under one ownership prior to final approval by the Planning Commission and City Council, and the application for final approval must be made by the owners of the entire site. The application shall include the following: A. A title report showing record ownership of the parcel or parcels upon which the PRD is to be developed. B. Guarantee ensuring the retention and continued maintenance of common open space, recreation facilities, and recreation structures. If development is to be done in phases, each phase must meet the requirements of this Section. C. Final development plans, which shall be in compliance with the approved preliminary development plans. D. The final plat, if applicable, pursuant to Chapter 58.17 RCW and Chapter 16.04 and 16.08 PAMC. E. Development schedule. F. Bond or other form of security acceptable to the City in a sufficient amount to complete the project or submitted phase, as determined by the City. G. Covenants, conditions and restrictions and /or homeowners association agreement. Section 2 - Retroactivity. This Ordinance shall apply retroactively to any planned residential development that was applied for prior to January 1, 1995 and has received preliminary approval but has not received final approval prior to the one -year deadline as set forth in PAMC 17.09.140, provided that any extension must be applied for within one -year of the effective date of this Ordinance. Section 3 - Effective Date. This Ordinance shall take effect five days after the date of publication by summary. Ordinance No. 2918 This Ordinance of the City of Port Angeles allows more flexibility in determining buffer requirements and creates a "minor construction" exemption in the Environmentally Sensitive Areas Protection Ordinance and amends Ordinance 2656 and Chapter 15.20 of the Port Angeles Municipal Code. Ordinance No. 2919 This Ordinance of the City of Port Angeles revises the requirements for final approval of planned residential developments so that each phase of a phased PRD shall have an additional one -year period for final approval, and the applicant may apply to the Planning Commission, and the Commission may approve, one or more one -year extensions as the Commission may deem appropriate. This Ordinance amends Ordinance 2038 and Chapter 17.19 of the Port Angeles Municipal Code. Ordinance No. 2920 This Ordinance of the City of Port Angeles relates to improvement exceptions for short plats in commercially zoned areas and amends Ordinance 2222, as amended, and Chapter 16.04 of the Port Angeles Municipal Code.
