HomeMy WebLinkAbout2929ORDINANCE NO. 2929 AN ORDINANCE of the City of Port Angeles, Washington, revising the City's shoreline management regulations, amending Ordinance 2033 as amended and Chapter 15.08 of the Port Angeles Municipal Code, and repealing Section 10 of Ordinance 2595 and PAMC 15.08.105. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Section 2 of Ordinance 2033 and PAMC 15.08.020 are hereby amended to read as follows: 15.08.020 RCW Sub Sections Adopted by Reference. The City adopts by reference the following sections or subsections of Chapter 90.58 RCW as now or hereafter amended: RCW 90.58.030 - Definitions and concepts. .040 - Program applicable to shorelines of the state. .050 - Program as cooperative between local government and state - Responsibilities differentiated. .100(1) - Program as constituting use regulations. .140 - Development permits - Grounds for granting - Administration by local government, conditions - Applications - Notices - Rescission - When permits not required - Approval when permit for variance or conditional use. . 147 - Substantial development permit - exemption for projects to improve fish or wildlife habitat or fish passage. .150 - Selective commercial timber cutting when. .160 - Prohibition against surface drilling for oil or gas, where. .180 - Appeals from granting, denying or rescinding permits, procedure Board to act, when - Local government appeals to board - Grounds for declaring master program invalid - Appeals to court, procedure. RCW 90.58.190 - Review and adjustments to master programs. .210 - Court actions to insure against conflicting uses and to enforce. .230 - Violators liable for damages resulting from violation - Attorney's fees and costs. .240 - Additional authority granted department and local governments. .270 - Nonapplication to certain structures, docks, developments, etc., placed in navigable waters - Nonapplication to certain rights of action, authority. - 1 - .320 - Height limitation respecting permits. .355 - Hazardous substance remedial actions - procedural requirements trot applicable. .380 - Adoption of wetland manual. .515 - Watershed restoration projects - exemption. Section 2. Section 3 of Ordinance 2033 as amended and PAMC 15.08.030 are hereby amended to read as follows: 15.08.030 Washington Administrative Code - Shoreline Guidelines Adopted. The City adopts by reference the following sections or subsections of Chapter 173 -14 WAC as now or hereafter amended: provided that. in the event of a conflict between the following Washington Administrative Code provisions and the Revised Code of Washington provisions adopted by reference in PAMC 15.08.020. the latter shall prevail: WAC 173 -14 -030 - Definitions. - 050 - Application of the permit system to substantial development undertaken prior to the act. -055 - Non - conforming development standards. - 060 - Time requirement of permit. - 062 - Applicability of permit system to federal agencies. - 064 - Revisions to permits. - 070 - Notice required. - 090 - Filing with department and attorney general. - 100 - Review criteria for substantial development permits. -110 - Application for substantial development, conditional use, or variance permit. - 115 - Letter of exemption. - 120 - Permits for substantial development, conditional use, or variance. - 130 - Department review of conditional use and variance permits. -140 - Review criteria for conditional use permits. WAC 173 -14 -150 - Review criteria for variance permits. -155 - Minimum standards for conditional use and variance permits. - 170 - Requests for review. - 174 - Certification of requests for review. Section 3. Section 10 of Ordinance 2595 and PAMC 15.08.105, which provide for the City Council conducting a public hearing on shoreline applications, are hereby repealed. Section 4 - Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 5 - Effective Date. This Ordinance shall take effect five days after the date of publication. Ordinance No. 2929 This Ordinance of the City of Port Angeles revises the City' s shoreline management regulations to bring the regulations into compliance with ESHB 1724 and amends Ordinance 2033, as amended, and Chapter 15.08 of the Port Angeles Municipal Code, and repeals Section 10 of Ordinance 2595 and PAMC 15.08.105. Ordinance No. 2930 This Ordinance of the City of Port Angeles alters the rates for the sale of electricity to take effect on all billings beginning November 1, 1996 and amends Ordinance 2776, as amended, and Chapter 13.12 of the Port Angeles Municipal Code. The full texts of the Ordinances are available, for a fee, at City Hall in the City Clerk' s office or will be mailed upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p. m.
