HomeMy WebLinkAbout2937ORDINANCE NO. 2937 AN ORDINANCE of the City of Port Angeles, Washington, adopting the Washington Model Traffic Ordinance (MTO) as contained in the Washington Administrative Code, Ch. 308 -330 WAC, to regulate traffic in the City of Port Angeles and amending Chapter 10.04 of the Port Angeles Municipal Code by repealing Ordinance 2443 and Ordinance 2133. WHEREAS, the state legislature has provided that each city is responsible for the prosecution, adjudication, sentencing and incarceration of misdemeanor and gross misdemeanor offenses committed by adults within its jurisdiction by adopting Section 39.34.180 RCW, which takes effect on January 1, 1997; and WHEREAS, the City of Port Angeles had not adopted those portions of the state motor vehicle laws which proscribed offenses classified as misdemeanors and gross misdemeanors as part of the motor vehicle code of the City of Port Angeles; and WHEREAS, the City Council has determined that the appropriate manner to fulfill the duties imposed upon the City by RCW 39.34.180is to adopt the provisions of the Washington Model Traffic Ordinance as contained in the Washington Administrative Code Chapter 308 -330, as provided in RCW 35A.12.140; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Section 10.04.010 of the Port Angeles Municipal Code is hereby amended to read as follows: 10.04.010 Adoption y Reference. The Washington Model Traffic Ordinance, Chapter 308 -330 WAC, is hereby adopted by reference as the traffic ordinance of the City of Port Angeles, Washington, as if set forth in full. /16.09.120(2), 46.09.130, 46.10.090(2), 46.10.130, Chaptcr 46.12, 46.16.028, 46.16.160, /16.20.021, 46.20.330,46.20.342, 16.20.4-10, 46.20.416,46.20.420, Chaptcr 46.29, 16.44.180, 46748.175, 46.52.010, 46.52.020, 46.52.090, 46.52.100, 46.52.130, 46.55.020, 46.61.015, - 1 - /16.61.020, 16.61.022, 46.61.021, 46.61.500, 46.61.502, 16.61.504, 56.61.520, 46.61.522, Section 2. Ordinances No. 2443 and 2133, and all ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 3. The repeal of Ordinances No. 2443 and 2133 shall not affect any pending or existing litigation and shall not operate as an abatement or bar to any action or proceeding pending under or by virtue of the repealed ordinances. Section 4 - Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 5 - Effective Date. This Ordinance shall take effect from and after January 1, 1997. This Ordinance shall take effect five days after the date of publication of this summary. Ordinance No. 2937 This Ordinance of the City of Port Angeles adopts the Washington Model Traffic Ordinance (MTO) as contained in the Washington Administrative Code, Ch. 308- 330 WAC, to regular traffic in the City of Port Angeles and amends Chapter 10.04 of the Port Angeles Municipal Code by repealing Ordinance No. 2443 and Ordinance No. 2133.
