HomeMy WebLinkAbout2939ORDINANCE NO. 2939 AN ORDINANCE of the City of Port Angeles, Washington, ordering certain local improvements and creating a local improvement district; providing for the payment of the cost of such improvements by special assessments; creating a local improvement district fund; and providing for the issuance and sale of local improvement district bonds and interim financing warrants or notes. WHEREAS, on November 5, 1996, the City Council (the "Council ") of the City of Port Angeles, Washington (the "City "), adopted Resolution No. 21 -96 declaring the City's intent to order sanitary sewer improvements within the Upper Golf Course area of the City and to create a local improvement district to finance the cost of constructing such improvements; and WHEREAS, a hearing was held on December 17, 1996, after notice as provided by law, and continued thereafter, and after discussion of the proposed improvements and due consideration thereof and of all objections thereto, the Council has determined to order the local improvements described below and to create a local improvement district; and WHEREAS, estimates of the costs and expenses of the proposed improvements, a description of the boundaries of the district, a statement of what portion of the costs and expenses of the improvements would be borne by the property within the proposed district, and a diagram showing the lots, tracts and parcels to be benefited and other information pertaining to the proposed district, have been filed with the City Clerk and certified to the City Council; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. The City shall design, acquire, construct and install the sewer improvements described in Exhibit A attached hereto and incorporated herein by this reference. The sewer improvements herein authorized shall be installed complete with all necessary lateral service connections, and other appurtenances necessary to the proper operation of the sewer system of the City. The foregoing sewer improvements are hereafter referred to as the "Improvements." Section 2. The preliminary plans and specifications for the Improvements, as prepared by consulting engineers and approved by the City Engineer, and now on file in the City Clerk's office, are hereby adopted and approved. The Improvements, when completed, shall be in accordance with said plans, the provisions of this ordinance and any other ordinances as hereafter may be adopted in connection herewith; provided, however, that changes in detail of such plans that do not significantly alter the scope or costs of the Improvements will not require further approval. Section 3. There is hereby established a local improvement district of the City to be known as "Local Improvement District No. 215 ( "LID No. 215 "). The boundaries of LID No. 215 shall be as described in Exhibit A attached hereto and incorporated herein by this reference. It is hereby found that the above - described boundaries embrace as nearly as practicable all the property specially benefitted by the Improvements. Section 4. The total cost and expense of the Improvements thereto is estimated to be $357,418.50, of which 100% shall be borne by and assessed against the property within LID No. 215 specially benefitted by the Improvements. Assessments shall be made against the property within LID No. 215 in accordance with the special benefits accruing to such property. The assessments shall be for the sole purpose of payment into the local improvement district bond fund hereinafter created for the payment of local improvement district bonds to be issued in part to defray the costs of the Improvements. Actual assessments may vary from the assessment estimates so long as they do not exceed a figure equal to increased true and fair value that the Improvements add to the property. Section 5. Upon completion of the Improvements, an assessment roll shall be prepared and, after notice and hearing in the manner provided by law, an assessment roll shall be confirmed. Assessments not paid within the 30 -day prepayment period provided by law shall be payable in installments, and the City shall issue local improvement district bonds payable from such unpaid installments. The number of years said installments shall run, the dates of payment of the same, and the rate of interest that the unpaid installments shall bear shall be as hereafter fixed by ordinance. Section 6. There is hereby created a fund of the City to be known as the "Local Improvement District No. 215 Fund" for the purpose of paying the cost of the Improvements provided for in this ordinance and into which there shall be paid all of the assessments collected in LID No. 215 as and when directed by the ordinance confirming the assessment roll. All money received from the sale of bonds, notes and warrants drawn on the LID No. 215 Fund shall be deposited into said fund and applied solely in payment of the costs and expenses of the Improvements. Section 7. Pending the issuance of local improvement district bonds, the City may, for the purpose of meeting any and all costs and expenses of constructing the Improvements for which funds are not otherwise available, as the same are installed prior to the sale of the bonds, issue interim financing warrants against the LID No. 215 Fund, or issue local improvement district bond anticipation notes pursuant to RCW Ch. 39.50, bearing interest at such rate or rates and with such terms as may hereafter be established by the Council by ordinance. Such interim warrants or notes, together with the interest due thereon to the date of delivery of the bonds, shall be redeemed and retired from the proceeds of the sale of local improvement district bonds or prepayments of assessments. Such warrants or notes shall be issued in an aggregate principal amount not in excess of the cost and expense of the Improvements. Section 8. It is the intention of the City to reimburse a portion of the costs of the Improvements with the proceeds of bonds to be issued by the City (the "Reimbursement Bonds "), the interest on which is excludable from gross income under Section 103 of the Internal Revenue Code of 1986, as amended. Section 9. This ordinance shall be effective five days from and after the date of its final passage and publication as provided by law. SANITARY SEWER INSTALLATION NARRATIVE All of the Local Improvement District area is currently served with on -site septic drain field systems. Many of these systems are failing and the proposed project will serve all of the properties with a new sanitary sewer system which will be connected to the City's public sewer facilities. There will be four main sewer lines to be installed on this project. The preliminary design locations of these sanitary sewer lines are as follows: 1. This main line is an 8 inch line with approximately 8 manholes and will begin approximately 290 feet south of Woodhaven Lane along the east property line of Lot 2 of the Woodhaven Short Plat. The sewer line will run north approximately 950 feet to the NE '/4 line of the NE '/4 of Section 14, Township 30 North, Range 6, W.W.M., then to the east approximately 940 feet to Golf Course Road, then north approximately 330 feet to the to the intersection of Golf Course Road and Melody Lane, then west approximately 270 feet along Melody Lane, and then north approximately 50 north and connecting to an existing sewer line. 2. This main line is an 8 inch line with approximately 5 manholes and will begin approximately 200 feet west of Golf Course Road on Woodhaven Lane and running west on Woodhaven Lane approximately 590 feet to the SE corner of Lot 4 of the Peterson Short Plat, then north approximately 417 feet along the east property line of said lot, then along the north line of Lots 2, 3, & 4 of Peterson Short Plat approximately 350 feet and connecting to main line number 1. 3. This main line is an 8 inch line with approximately 5 manholes and will begin approximately 400 feet east of Golf Course Road on the north side of Maddock Road. The sewer line will run west to the intersection of Maddock Road and Golf Course Road, then north approximately 1300 feet along the west edge of Golf Course Road and connecting to main line number 1. 4. This main line is an 8 inch line with approximately 2 manholes and will begin connected to the main line number 1 on the east side of Golf Course Road at the intersection of Lindberg Road and running east approximately 400 feet along Lindberg Road along the south side. Ordinance No. 2940 This Ordinance of the City of Port Angeles revises the Budget for the fiscal year ending December 31, 1996, adopts the budget for the fiscal year ending December 31, 1997, and amends Ordinance No. 2901. Ordinance No. 2941 This Ordinance of the City of Port Angeles revises to eight percent the tax upon the City's solid waste and water /wastewater utilities and amends Ordinance No. 2183, as amended, and Section 5.80.040 of the Port Angeles Municipal Code. This Ordinance shall take effect January 1, 1997. Ordinance No. 2942 This Ordinance of the City of Port Angeles amends the Parking Ordinance to reflect changes in State law, to increase parking fines and to provide for collection of unpaid parking frees, amends Ordinance No. 2451, as amended, and Chapter 10.20 of the Port Angeles Municipal Code. This Ordinance shall take effect on January 1, 1997. Ordinance No. 2943 This Ordinance of the City of Port Angeles provides for prosecution, adjudication, sentencing and incarceration of misdemeanor and gross misdemeanor offenses pursuant to Laws of 1976, Chapter 308, Section o and RCW 39.34.180, adopting by reference the misdemeanor and gross misdemeanor provisions of the Revised Code of Washington, and amends Ordinance No. 2129, as amended, and Title 9 of the Port Angeles Municipal Code. This Ordinance shall take effect on January 1, 1997. Ordinance No. 2944 This Ordinance of the City of Port Angeles establishes a Money Back Guarantee Program to assure processing of development permit applications within established time frames and amends Ordinance No. 2789, as amended, and Chapter 3.70 of the Port Angeles Municipal Code. This Ordinance shall take effect five days after the date of publication of this summary.
