HomeMy WebLinkAbout2944ORDINANCE NO. 2944 AN ORDINANCE of the City of Port Angeles, Washington, establishing a Money Back Guarantee Program to assure processing of development permit applications within established time frames and amending Ordinance 2789 as amended and Chapter 3.70 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY }ORDAIN as follows: Section 1. Ordinance 2789 as amended and Chapter 3.70 of the Port Angeles Municipal Code are hereby amended by adding a new section to read as follows: 3.70.905 Money Back Guarantee Program. In order to assure that specified development permit applications are processed within a reasonable amount of time, the City hereby adopts the Money Back Guarantee Program. Under this program, applications for building permits, other construction permits, subdivisions, short plats, boundary line adjustments, conditional uses, unclassified uses, shoreline substantial development permits, approvals required by the Environmentally Sensitive Areas Ordinance and Wetlands Ordinance, site specific rezones, variances, right -of -way use permits, street vacations, and clearing and grading permits shall be processed in accordance with the time frames set forth in this section, provided that the following development permit applica- tions shall be specifically excluded from the Money Back Guarantee Program: planned residential developments, projects for which a EPA determination of significance has been made, and building permits for projects with fees calculated on construction valuation costs greater than $300,000. 1. Once the City determines a development permit - 1 - 1. Once the City determines a development permit application to be complete, the City has sixty days to review an application that does not require a public hearing. 2. Once the City determines a development permit application to be complete, the City has 120 days to review an application that does require a public hearing. 3. The sixty and 120 -day review periods shall not include any period for which the City has asked the applicant in writing to provide additional information, beginning with the date of the written request until the date the City receives the information. The review time shall also be tolled or held in abeyance whenever the City asks in writing for additional information or whenever the City is waiting for a required determination or other action by an agency with jurisdiction. 4. If the City fails to complete its permit application review within the time limits identified in subsections 1 -3 above, then the applicant shall be entitled to a full refund of applica- tion fees paid to the City. In the event a refund is required, the City must still complete its review of the application. 5. The permit applicant may waive the time limits set forth in this section. Section 2 - Effective Date. This Ordinance shall take effect five days after the date of publication. Ordinance No. 2941 This Ordinance of the City of Port Angeles revises to eight percent the tax upon the City's solid waste and water /wastewater utilities and amends Ordinance No. 2183, as amended, and Section 5.80.040 of the Port Angeles Municipal Code. This Ordinance shall take effect January 1, 1997. Ordinance No. 2942 This Ordinance of the City of Port Angeles amends the Parking Ordinance to reflect changes in State law, to increase parking fines and to provide for collection of unpaid parking fines, amends Ordinance No. 2451, as amended, and Chapter 10.20 of the Port Angeles Municipal Code. This Ordinance shall take effect on January 1, 1997. Ordinance No. 2943 This Ordinance of the City of Port Angeles provides for prosecution, adjudication, sentencing and incarceration of misdemeanor and gross misdemeanor offenses pursuant to Laws of 1976, Chapter 308, Section o and RCW 39.34.180, adopting by reference the misdemeanor and gross misdemeanor provisions of the Revised Code of Washington, and amends Ordinance No. 2129, as amended, and Title 9 of the Port Angeles Municipal Code. This Ordinance shall take effect on January 1, 1997.
