HomeMy WebLinkAbout2972ORDINANCE NO. 2972 AN ORDINANCE of the City of Port Angeles, Washington, establishing the Lodging Tax Advisory Committee, defining its membership, duties and organization, and adding a new Chapter 2.70 to the Port Angeles Municipal Code. Whereas, for the past two fiscal years the Port Angeles City Council has appointed an advisory committee to recommend to the Council how to allocate the two percent (2 %) lodging excise tax that the City is authorized to collect under RCW 67.28.180 and Chapter 3.48 PAMC; and Whereas, during its 1997 regular session, the Washington State Legislature amended the lodging tax statutes to require municipalities to form advisory committees, such as the City of Port Angeles had previously done, to make recommendations to legislative bodies as to continuing the tax at the current 2% rate, imposing an additional two percent (2 %) tax, and allocating the available tax revenues; and Whereas, the Port Angeles City Council has considered the requirements of the new state statute, has interviewed interested applicants for a lodging tax advisory committee, and has determined that the committee should be formally constituted as set forth in this Ordinance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. A new Chapter 2.70 is hereby created and added to Title 2 of the Port Angeles Municipal Code to read as follows: 1 Chapter 2.70 Sections: 2.70.010 Purpose 2.70.020 Committee Created 2.70.030 Membership 2.70.040 Organization 2.70.050 Duties 2.70.010 Purpose. The declared purpose of this Chapter is to establish a lodging tax advisory committee to be constituted and have the duties as required by the Washington State Legislature in Chapter 452, Laws of 1997. The Lodging Tax Advisory Committee will make recommendations to the City Council on matters related to the lodging tax as required by the State statute and as may be referred to the Committee by the City Council. 7.70.020 Committee Created. There is hereby created the Port Angeles Lodging Tax Advisory Committee, which shall be constituted, organized, and have the duties as set forth in this Chapter. 2.70.030 Membership. A. Composition. The Lodging Tax Advisory Committee shall be composed of the following eleven members: 1. Two City Council members. 2. Three members who are representatives of businesses required to collect the lodging excise tax. 3. Three members who are persons involved in activities authorized to be funded by lodging excise tax revenue. 4. Two citizen -at -large members who neither represent businesses -2- required to collect the lodging excise tax nor are persons involved in activities authorized to be funded by the lodging excise tax. 5. One member who is a representative of the Downtown Forward Executive Committee. B. Procedures and Criteria. The members of the Committee shall be appointed by the City Council consistent with the following criteria: 1. Members shall be residents of the City or representatives of businesses within the City. 2. Members shall have displayed an interest in the work of the Committee. 3. Members shall have declared in their applications which category of membership they are applying for, so that members shall be eligible for only one of the categories set forth in PAMC 2.70.030A. C. Terms. 1. The term of office shall be one (1) year. 2. Members may be appointed by the City Council for successive terms. 3. Appointments to fill an unexpired term shall be only for the remainder of that term, after which a reappointment may be made. 2, 70.040 Organization. A. As required by the State lodging tax statute, the chairperson of the Committee shall be one of the two Council members. The vice chairperson shall be the other - 3 - Council member. B. The City Manager shall designate City staff to provide administrative support for the Committee, including being responsible for written minutes of the Committee's meetings, publication of meeting notices, and other administrative and clerical functions for the Committee. C. The Committee shall hold meetings as deemed necessary by the Committee and the City Council to carry out its duties. All meetings shall be conducted in compliance with the Open Public Meetings Act, Chapter 42.30 RCW. Six members shall constitute a quorum for the conduct of official business. 2.70.050 Duties. The duties of the Committee shall include the following: A. Review, comment, and make recommendations to the City Council with regard to increasing the current 2% lodging excise tax by not more than an additional 2% or continuing the tax at the current rate. The Committee shall submit its comments and recommendations to the City Council with an analysis of the extent to which the recommended tax rate will accommodate activities for tourists or increase tourism and the extent to which the recommended tax rate will affect the long -term stability of the City's lodging excise tax fund. B. Review, comment, and make recommendations to the City Council on activities and /or facilities to be funded by lodging excise tax revenues. The Committee's comments shall indicate how its recommendations are related to the statutory purposes of paying for the cost of tourism promotion and/or acquisition or operation of tourism - related facilities. The Committee's recommendations shall be presented to the City Council in a timely fashion consistent with the City's budget cycle so that the tax revenue allocations can be included in the -4- City's annual budget or in a later budget amendment as may by authorized by the City Council. Section 2. Severability. If any provisions of this Ordinance, or its application to any person or circumstances, is held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 3 - Effective Date. This Ordinance shall take effect five days after the date of publication.
